ZONING BOARD OF APPEALS

SEPTEMBER 24, 2008

MEETING

 

 

PRESENT: Chairman Richard Dixon, James Cownie, Richard Bumpus, Jerry Moore, and Myrna Hallenbeck

 

ABSENT: None

 

ALSO PRESENT: CEO Michael Stewart, Zoning Board Clerk Cheryl Gifford

 

 

Chairman Dixon opened the meeting at 7:00PM

 

MOTION:  Upon motion made by James Cownie and 2nd by Richard Bumpus the

                   Minutes from the August 27, 2008 meeting were approved as written by the

                    Clerk.  All in favor (5) Dixon, Cownie, Hallenbeck, Bumpus, and Moore.

 

 

NEW BUSINESS

 

  1. SETBACK VARIANCE

EDWARD HURST

Location: 1718 State Hwy 30, Mayfield

 

Edward Hurst was present at the meeting to discuss his application.  A 239 form was filed with the Fulton County Planning Board, and their review determined that there would be no regional implications.  A small discussion on the application and the following motion was made.

 

MOTION:  Upon motion made by James Cownie and 2nd by Myrna Hallenbeck a Public Hearing was set for October 8, 2008 at 7:10PM for the purpose of replacing a singlewide manufactured home with  a new doublewide  manufactured home, per Section 401-D of the Local Law #2  of the year 2006.  All in favor (5) Dixon, Cownie, Hallenbeck, Bumpus, and Moore.

Location:  3117 State Hwy 30, Mayfield

 

The Chairman reviewed the application with the Board.  A 239 form was filed with the Fulton County Planning Board.  The Fulton County Planning Board declared the application as no regional implications.  The following motion was made.

 

MOTION:  Upon motion made by Mr. Bumpus and 2nd by Jerry Moore a Public Hearing is set for October 8, 2008 at 7:20PM for the purpose of replacing a singlewide mobile home with a new one, per Section 401-D of Local Law # 2 of the year 2006.  All in favor (5) Dixon, Cownie, Bumpus, Hallenbeck, and Moore.

   

  1. SIDE SETBACK

      Location:  250 Maple Ridge, Mayfield

 

      The Board reviewed the application, and the following motion was made. 

 MOTION:  Upon motion made by Myrna Hallenbeck, and 2nd by  Mr. Cownie a Public Hearing is set for October 8, 2008 at 7:30PM for the purpose of adding a deck to the existing home per Section  401-D of Local Law #2 of the year 2006.  All in favor (5) Dixon, Cownie, Bumpus, Hallenbeck, and Moore.

 

 

 

OLD BUSINESS

        Location: 244 Gray Rd., Mayfield

  Use Variance

 

A lengthy discussion was held between the Zoning Board of Appeals and the CEO in regards to the law for UseVariances.  The following motion was made.

 

 

 

 

 

 

MOTION:  Upon made made by Mr. Cownie and 2nd by Myrna Hallenbeck a

Public Hearing is set for October 22, 2008 at 7:10PM for the purpose of placing a  1978 Singlewide manufactured home at 244 Gray Road in Mayfield.  Mr. DaCorsi will have to provide the proper documentation to support the approval per Section  301-5A-1 of Local Law #2 for the year 2006.  All in favor (5) Dixon, Cownie, Bumpus, Hallenbeck, and Moore.

 

The Board has requested the Clerk to secure the October 8, 2008 date for the Zoning Board of Appeals additional meeting.

 

CORRESPONDENCE

 

A letter was sent to the Chairman from the State in regards to remapping State land.  The Board expressed  concern for the Lake area.

 

Board member Myrna Hallenbeck shared with the Board a letter she had  in regards to carrying over credits from year to year from training sessions.  The Association of Towns accepts carry  over credits from year to year, therefore it would be the Towns discretion to carry over credits for members who have extra credits.

 

MOTION:  Upon motion made by Mr. Bumpus and 2nd by Myrna Hallenbeck the meeting was adjourned at 8:00PM.  All in favor (5) Dixon, Cownie, Bumpus, Hallenbeck, and Moore.
