TOWN OF MAYFIELD

ZONING BOARD OF APPEALS

MEETING MAY 28, 2008

 

 

PRESENT: Richard Dixon,Chairman

                   Richard Bumpus Jr., Board Member

                   James Cownie, Board Member

                   Myrna Hallenbeck, Board Member

                   Jerry Moore, Board Member

 

ABSENT:  None

 

OTHERS PRESENT: Michael Stewart, CEO, Cheryl Gifford, Zoning Clerk

 

Chairman Richard Dixon requested the meeting opened at 7:00PM, he welcomed all present

 

MOTION:  Upon motion made by  Myrna Hallenbeck and 2nd by Richard Bumpus the meeting was opened at 7:00PM.  All in favor (5) yes (Dixon, Bumpus, Cownie, Moore, and Hallenbeck).

 

A discussion was held on meeting paperwork.  The clerk requested Board member emails to forward agenda and meeting minutes.

 

APPROVAL OF MINUTES:

Motion made by Mr. Cownie, and 2nd by Myrna Hallenbeck to approve the April 23, 2008 minutes as written by the Clerk.  All in favor (5) yes (Hallenbeck, Cownie, Dixon, Bumpus Jr., and Moore).

 

CORRESPONDENCE:

Mr. Dixon discussed the mandatory training sessions with the Board.  Mr. Dixon received a summer training session listing and forwarded a copy for the Board members.

 

NEW APPLICANT:

Location: 2082 ST HWY 30, Mayfield

SBL # 88.-4-13

Variance: Percent of Lot Coverage from Section 401-D

A discussion was held on  the property, and Mr. Cownie asked the CEO if there was any progress on the Zoning changes.  Mike responded with the Town Board is still examining the changes and have not yet passed any of the recommendations.

 

MOTION Upon motion made by Mr. Cownie  and 2nd by Myrna Hallenbeck a Public hearing is set for Wednesday June 25, 2008 at 7:10PM for Percent of Lot Coverage per section 401 D of the Local Law # 2 of 2006..  All in favor (5) yes, (Dixon, Hallenbeck, Cownie, Bumpus Jr., and Moore)

Theresa DaCorsi

Location: 244 Gray Rd., Mayfield

SBL # 88.-2-14

Variance: The maximum age for type II dwelling from Section 301-5A-1

 

A discussion was held on the maximum age of a dwelling.  Another issue with this application is categorizing it under Use or Area.  Mike Stewart stated after a conversation with the Town Attorney Carm Greco it was determined to be a Use Variance.  The Zoning Board of Appeals asked that Mike contact some other agency such as the Dept of State for further clarification.  Mike also noted that the Deed would need to be changed to the current or correct owners.  It was the wishes of the Zoning Board to go ahead and schedule the Public Hearing contingent on receiving  further information.

 

MOTION:  Upon motion made by Mr. Bumpus and 2nd by Myrna Hallenbeck a Public Hearing for Theresa  DaCorsi is scheduled for Wednesday June 25, 2008 at 7:40PM for the Maximum age of a dwelling from Section 301-5A-1 of Local Law # 2 of 2006.   All in favor (5) yes (Hallenbeck, Dixon, Bumpus Cownie, and Moore).

Location:  327 Riceville Rd., Gloversville

Variance: Set Back from Section 401 D

 

A small discussion was held on the property and proposed deck...

 

MOTION:  Upon motion made by Mr. Bumpus and 2nd by Myrna Hallenbeck a Public Hearing is scheduled for Wednesday June 25, 2008 at 7:20PM for a 15 foot side set back from Section 401-D of Local Law # 2 of 2006.  All in favor (5) yes (Hallenbeck, Dixon, Cownie, Bumpus, and Moore).

Variance: Set Back from Section 401-D

 

A discussion was held on the application, and the map was reviewed.

 

MOTION:   Upon motion made by Mr. Bumpus and 2nd by Mr. Cownie a Public Hearing is set for Wednesday June 25, 2008 at 7:30PM for a 15 foot set back from  Section 401-D of  Local Law # 2 of 2006.  All in favor (5) yes (Dixon, Hallenbeck, Bumpus, Cownie, and Moore).

 

MOTION:  Upon motion made by Mr. Bumpus and 2nd by Mr. Cownie the meeting was closed at 8:00PM.  All in favor (5) (Dixon, Cownie, Bumpus, Hallenbeck, and Moore).
