ZONING BOARD OF APPEALS



At the regular meeting of The Board of Appeals, Town of Mayfield, Fulton County, New York held on Wednesday March 22, 2006 at the Mayfield Municipal Complex 28 North School St at 7:00 p.m., there were


PRESENT:       Wesley Muddle, Chairman

                        Myrna Hallenbeck, Board Member

                        Richard Bumpus Jr. Board Member

                        James Cownie, Board Member

                        Richard Dixon, Board Member


OTHERS PRESENT:  Mike Stewart CEO, Kim Landers, Charles Landers, (representing Juanita Belcher), Kathy Canary clerk.


Chairman Muddle opened the meeting at 7:05 pm


APPROVAL OF MINUTES-on a motion by James Cownie and seconded by Richard Bumpus Jr. the minutes of February 22, 2006 were approved with the correction of Dennie Rd changed to Delaney Rd. Carried 5(five) AYES 0(zero) NAYS.


PUBLIC: none at this time


CORRESPONDENCE:  A formal letter in reference to the filing fee of $35.00 dollars will be sent to the Town Board. This filing fee was approved by the board in their March 16, 2006 meeting.  An informal letter will be sent to the Town Board requesting an extension to allocate more time to the Local Law 2 of 2005 Section 301-13-C1.             


PUBLIC HEARING: 

 

Chairman Muddle made a motion to open the Public Hearing as advertised and scheduled for this evening at 7:10 pm.  Following a discussion of Interpretation for Local Law 2 of 2005 Section 301-13-C1that was submitted for Juanita Belcher a legal notice was printed on March 15, 2006 in the Leader Herald and Recorder.  A copy of said notice was given to the clerk to be included in the record.  The Zoning Board explained to Charles and Kim Landers, party representing Juanita Belcher and said party proposing to construct a house on the Delaney Rd property; this board does not have the authority to change the law.  The board advised the Landers to approach the Town Board with their request for a change to LL 2 of 2005 Section 301-13-C1. ALL IN FAVOR 5(five) AYES 0(zero) NAYS. Motion to close public hearing made. All in favor 5(five) AYES 0(zero) NAYS.


MODIFICATIONS TO ZONING LAW:


A discussion was held on LL 2 of 2005 Section 301-13-C1.  A possible change to the law is allowing more use with site plan review.  This possible change will need more consideration.  The matter was tabled until next meeting.

VARIANCE APPLICATION:


1.) CLAYTON CHRISTMAN:

An application was submitted on March 16, 2006 for property located at 116 North Pine Tree Dr, Tax Parcel ID # 136-8-22.  He is proposing to build a garage with a setback of 35 ft.  This proposal does not comply with Section 401 D of Local Law 2 of 2005 as it applies to a 50 ft minimum yard distance.  The board discussed the application and a motion to schedule a public hearing for Clayton Christman on April 26, 2006 at 7:10 pm was made.

2.) ROBERT HAUGAARD:

An application was submitted on March 8, 2006 for property located at 177 County Highway 155 Tax Parcel ID # 137-4-28.  The proposal is to build an addition to the back of the original structure.  This proposal does not comply with Section 803-A of Local Law 2 of 2005, which states a NON conforming building shall not be added to or enlarged in any manner greater than 25 percent of the original square footage. 

Haugaard Application Decision :

The board has determined this building to be a conforming building –Home occupancy 2- and is exempt from this law therefore a variance is not required.  The board will refer the applicant to the planning board.  This application is withdrawn from the Zoning Board and referred to the Planning Board.

3.) JOE TESIERO:

An application was submitted on March 21, 2006 for property located at 215 North Second Ave, Broadalbin NY Tax Parcel 137.-4 -11.120.  He is proposing to build an addition on the existing residence.  This proposal does not comply with Section 401-D of Local Law 2 of 2005 as it applies to maximum percent of lot occupied by principal building.  The board discussed the application and a motion to schedule a public hearing for Joe Tesiero on April 26, 2006 at 7:20 pm was made.


Myrna Hallenbeck made a motion to adjourn the meeting at 8:15 pm and James Cownie seconded.
