At the regular meeting of The Board of Appeals, Town of Mayfield, Fulton County, New York held at the Village Hall at 7:00 p.m., there were

PRESENT: James Cownie, Chairman

Richard Bumpus Jr., Board Member

Myrna Hallenbeck, Board Member

ABSENT: Richard Dixon, Board Member

Wesley Muddle, Board Member

OTHERS PRESENT: Cindy Ostrander, Clerk.

Chairman Cownie opened the meeting at 7:05 p.m.

APPROVAL OF MINUTES-on a motion by Myrna Hallenbeck and seconded by Richard Bumpus Jr. the minutes of October 26, 2005 were approved as submitted.

CARRIED 3(three) AYES (Cownie, Hallenbeck, Bumpus Jr.) 0(zero) NAYS

Absent (Dixon, Muddle)

CORRESPONDENCE/UPDATES

Conference-Saratoga Planning & Zoning-January 25, 2006-Richard Bumpus Jr. expressed interest in attending.

VARIANCE APPLICATION

1. Edward Fallis

An application was submitted December 1, 2005 by Wendy Putman on behalf of Edward Fallis for property located at 124 Gray Road, SBL#103.-4-19. He is proposing to build a handicap access ramp that meets code for slope from the front door of the existing residence. Ramp will be within 8 of Gray Road. This proposal does not comply with Section 401-D of Local Law #2 for the year 2005 as it applies to a 50 ft minimum front yard distance. The board discussed the application and a motion to schedule a Public Hearing for Edward Fallis on January 25, 2006 at 7:10 pm was made by James Cownie and seconded by Myrna Hallenbeck.

OTHER

The board discussed appointing a new chairman for 2006. James Cownie made a motion to appoint Wesley Muddle as Chairman of the Zoning Board of Appeals for 2006, Richard Bumpus Jr. seconded. CARRIED 3(three) AYES (Cownie, Hallenbeck, Bumpus Jr.) 0(zero) NAYS Absent (Dixon, Muddle)

The new Town Board will appoint a ZBA board member to succeed Richard Dixon, whose term expires 12/31/05. The Board has been advised that Mr. Dixon is agreeable to serving another term.

The Zoning Board of Appeals will wait to appoint a Vice-Chairman for 2006 until the full five member board is present at an upcoming meeting.

Chairman Cownie made a motion to adjourn the meeting at 8:00 p.m., Myrna Hallenbeck seconded.
