TOWN OF MAYFIELD

PLANNING BOARD MEETING

MARCH 12, 2008

 

PRESENT:Chairman Walt Ryan, John Vadney, Nancy Deitch,  and Barney Brower

 

ABSENT: Marilyn Salvione

The Chairman, Walt Ryan  opened the workshop meeting at 6:30PM.

 

MOTION: Upon motion made by John Vadney and 2nd by Barney Brower the February 20, 2008  minutes were approved with the following corrections: Correctly spelling February heading; 4th paragraph Section 504-B and C to state Vice Chairman John Vadney asked each member to review Section 504 of the Zoning Law and be prepared to make recommendations as to size of sign for each zone at the next Planning Board meeting. Last correction ; 6th paragraph to state also a discussion was held on  design standards as they apply to C1 Districts.  All in Favor (4), Vadney Ryan,Brower, and Deitch.

 

The Chairman made the Following Motions 1-10

 

RESOLUTION #1

MOTION made by Walt Ryan and 2nd by Nancy Deitch as follows:

Resolution to recommend to the Town Board that the following changes be made to the Zoning Law:

Section 404, B;1

Original language replace by the following:

     The maximum height of an accessory building located in R-1, R-2 or R-E Districts shall not be more than 25 feet.  The maximum height of an accessory building located in L-1 or L-2 Districts shall not be more than 20 feet.  Agricultural, Commercial, and Industrial uses shall not be subject to this provision.  All in Favor (4) Ryan, Vadney, Brower, and Deitch.

 

RESOLUTION #2

MOTION made by Walt Ryan and 2nd by Barney Brower as follows:

Resolution  to recommend to the Town Board that the following changes be made to the Zoning Law:

Section 404, C; 1C

Original language be removed and not replaced.

All in Favor (4) Ryan, Vadney, Brower, and Deitch.

 

RESOLUTION #3

MOTION made by Walt Ryan and 2nd by Barney Brower as follows:

Resolution to recommend to the Town Board that the following changes be made to the Zoning Law:

Section 202, A; 42

Original language be removed and replaced by the following:

 

     #42 Home Occupations (new)

 

Individuals proposing a Home Occupation shall present their concept to the Planning Board who will determine whether the Home Occupation will be allowed and whether a Site Plan Review will be required.  The Planning Board will consider each application on an individual basis and evaluate how the proposed use will conform to the Zoning Law and the Comprehensive Plan.  Home Occupations are defined as businesses where the owner resides on the property and where the activities of the business are conducted inside the residence, a legally constructed accessory building, or at off -site locations.  The following items or activities must not be left or performed outdoors on the property:

     1.  Any item for sale, to be serviced or awaiting pick-up by a customer.

     2.  No service activity performed or process equipment used.

     3.  No raw material used in the production of a finished product.

The following items may be outdoors on the property:

     1.  Signs which advertise the business, not to exceed 6 square feet in size.

     2.  Display of licenses required by New York State.

     3.  Licensed motor vehicles used for the business.

     4.  Mobil machinery used in the business.

The Planning Board will also consider any adverse effect the Home Occupation could potentially have on the value of neighboring properties, resulting from increased noise, odor, lighting, traffic, and the degree to which these factors are mitigated by distances, screening and on-site parking.  All in Favor (4) Ryan, Vadney, Brower, and Deitch.

 

RESOLUTION #4

MOTION made by Walt Ryan and 2nd by John Vadney as follows:

Resolution to recommend to the Town Board that the following changes be mane to the Zoning Law:

Section 302

That the following lots within the Town  of Mayfield as designated by the Tax Map numbers shall be changed from their current Zoning District to the I-1 District.  All in Favor (4) Ryan, Vadney, Brower, and Deitch.

Resolution to recommend to the Town Board that the following changes be made to the Zoning Law:

Section 302

RESOLUTION #6

MOTION made by Walt Ryan and 2nd by Nancy Deitch as follows:

Resolution to recommend to the Town Board that the following changes be made to the Zoning Law:

 

Section 1002 A

Add the following sentence to the end of this section:

 

Any single story storage building, less than 144 square feet in size in an R-1, R-2, R-e, L-1, L-2, or Ag District is exempt from the Building Permit requirement.  All in Favor (4) Ryan, Vadney, Brower, and Deitch.

 

RESOLUTION #7

MOTION made by Walt Ryan and 2nd by  John Vadney as follows:

Resolution to recommend to the Town Board that the following changes be made to the Zoning Law:

 

Section 401; D

Change the footnote in the Bulk Requirement table to read as follows:

 

*Non-commercial uses in the C-1 District shall be subject to a minimum front yard distance (road side) of 50 feet.  All in Favor (4) Ryan, Vadney, Brower, and Deitch.

 

RESOLUTION #8

MOTION made by Walt Ryan and 2nd by Nancy Deitch as follows:

Resolution to recommend to the Town Board that the following changes be made to the Zoning Law:

 

Section 301-12: C-1, 3 Item 3

To read as follows:

 

All uses allowed in R-1, or R-2 Districts, with the exception of Mobile Home Parks (exempt from Site Plan Review).  All in Favor (4) Ryan, Vadney, Brower, and Deitch.

 

RESOLUTION #9

MOTION made by Walt Ryan and 2nd by Barney Brower as follows:

Resolution to recommend to the Town Board that the following changes be made to the  Town Law # 280.

 

Establishing an open development area for the entire Town, Wherein permits may be issued for the erection of structures to which access is given by permanent and deeded right of way or easement.  All in Favor (4) Ryan, Vadney, Brower, and Deitch.

 

RESOLUTION #10

MOTION made by  Walt Ryan and 2nd by John Vadney as follows:

Resolution to recommend to the Town Board that the following changes be mane to the Zoning Law:

 

Section 803, C, Page 55

 

Eliminate the sentence in this paragraph:

Such change shall be subject to Site Plan Review.  All in Favor (4) Ryan, Vadney, Brower, and Deitch.

 

Chairman Ryan brought three items for discussion:

1.    NYS DOT Corridor Study

2.    NYS Storm Water Run-Off

3.    Outdoor Wood Burning Furnaces

At previous Planning Board meetings the Corridor Study was discussed.  At this meeting, a brief discussion was held on the Corridor Study. It is the consensus of the Planning Board  to Recommend to the Town Board to NOT adopt recommendations by the State on the RT 30 Corridor Study. 

 

Storm Water Run-Off was discussed by the Board, the Consensus of  the Board was to take no action at this time.

 

A discussion was held on the up coming  State Regulations on Outdoor Wood Burning Furnaces.  The consensus of the Planning Board was to make no recommendations to the Town Board at this time.

 

At the conclusion of the meeting Chairman Ryan read to the Board a proposed letter that will accompany the Planning Boards recommendations to the changes in the Zoning Law to the Town Board in April.

 

John Vadney made a chart for Sign Size for all the Board members to look at and compare sizes for each district.  A small discussion was held.

 

MOTION: upon Motion made by Walt Ryan and 2nd by Barney Brower the meeting was adjourned at 8:00PM.  All in favor (4) Ryan, Vadney, Brower, and Deitch.
