At a meeting of the Mayfield Planning Board, Town of Mayfield, Fulton County, New York, held on Wednesday March 29, 2006 at the Mayfield Municipal Complex, 28 North School Street at 7:00 pm there were

 

PRESENT:

Arthur Dahl, Chairman

Nancy Deitch, Board Member

Marilyn Salvione, Board Member

John Vadney, Board Member

Robert Cooper, Board Member

 

OTHERS PRESENT: Mayfield Village Mayor Gregg Deitch, Kathy Canary, Planning Board Clerk.

 

Chairman Arthur Dahl called the meeting to order at 7:00 pm.

 

APPROVAL OF MINUTES-A motion was made by Marilyn Salvione seconded by Nancy Deitch to approve the minutes of March 15, 2006 as submitted. Carried 5 (five) AYES 0(zero) NAYS.

 

NEW BUSINESS:

 

Mr. Donald Russell submitted revised plans of the plans approved of in 1998.  The revised plans only involve lot line amendment on lot number 15.  He is proposing to make the lot line 30 feet toward route 30 and will still meet the side lot requirement.

The opinion of the town attorney in general is that a lot line adjustment does not require Planning Board action.  Nancy Deitch makes a motion that we deem this modification a lot line amendment adjustment not requiring Planning Board approval providing the square footage after the adjustment remains the same or higher seconded by Marilyn Salvione. ALL IN FAVOR CARRIED 5(five) AYES 0(zero) NAYS

 

Sunset Bay Camp Ground and Marina have acquired a piece of property and are contemplating extending their docks into permit area onto the adjoining piece of property they have acquired. Marilyn Salvione made a motion the creation of docks on land that is a permit area of the regulating district even though used for a business purpose does not require site plan review, having concluded this to be outside our jurisdiction, seconded by John Vadney ALL IN FAVOR 5(five) AYES 0(zero)NAYS

 

ZONING LAW MODIFICATIONS

 

The board held an extensive discussion on how to modify the LL 2 of 2005 Section 401:D.  The board weighed many issues pertaining to this law.  The board’s objective is to find a fair adjustment to the 3 acre requirement under this law and to improve open space.  We will suggest to the town board that in agricultural zones for lots abutting State, County, or Town roads in existence as of this date March 29,2006 the minimum lot size

 be 2 acres with a minimum 150 feet frontage and a minimum setback of 75 feet, and for Town or private roads constructed after March 29, 2006 as designated by the Planning Board the minimum acreage lot size be 11/2 acres with minimum 150 feet frontage and a minimum setback of 50 feet.  Further that for lands gifted to sons or daughters the minimum lot size be 1 acre with minimum 150 feet frontage and a minimum setback of 50 feet.  Nancy Deitch made a motion to accept the modification to LL2 of 2005 Section 401:D seconded by Marilyn Salvione. ALL IN FAVOR CARRIED 5(five) AYES 0(zero)NAYS.

 

The board revisited item number 14 of Mike Stewarts, CEO, Zoning Law Items for Review LL 2 of 2005 Section 301-13:C1.  The previous proposed change addressed in the March 15, 2006 meeting was to require site plan review which will also require County Planning Board approval if located on a State or County Highway.  After much discussion the board’s modifications are to strengthen this proposed law change by preserving site plan review and adding the requirement of a minimum lot size of 1 acre with minimum 150 feet frontage and a minimum setback of 75 feet.

ALL IN FAVOR CARRIED 5(five) AYES 0(zero) NAYS.

 

Next meeting scheduled for April 5, 2006 at 7:00 pm will be a continuation of the Zoning Law Modifications.  Items 2-6 on the Zoning Law Items for Review supplied by Mike Stewart, CEO, will be discussed.

 

On motion by John Vadney seconded by Robert Cooper the meeting was adjourned at 8:30 pm.
