At a special meeting of the Mayfield Planning Board, Town of Mayfield, Fulton County, New York, held on Wednesday May 3, 2006 at the Mayfield Municipal Complex, 28 North School Street at 7:00 pm there were


PRESENT:

Arthur Dahl, Chairman

Nancy Deitch, Board Member

Marilyn Salvione, Board Member

John Vadney, Board Member


EXCUSED: Robert Cooper, Board Member

OTHERS PRESENT: Kathy Canary Planning Board Clerk.


Chairman Arthur Dahl called the meeting to order at 7:00 pm.


APPROVAL OF MINUTES-A motion was made by John Vadney and seconded by Marilyn Salvione to approve the minutes of April 19, 2006 as submitted. Carried 4 (four) AYES 0(zero) NAYS.



NEW BUSINESS:

The board discussed the Site Plan Application for Delaney Properties.  Mr. Delaney is proposing to add 6,975 square feet with basement and additional 18 parking spaces to his existing office located on St Hwy 30 Tax Parcel # 119.00-9-6.  The board conducted a short environmental review and determined based on reviewing the proposed project we see no significant adverse or environmental effect.  Due to the fact this property is within 500 feet of a state or county highway, the proposal will be presented to the County Planning Board for review and comment.

PLANNING BOARD ACTION:

A motion made by Marilyn Salvione to declare the proposed site plan to have a (negative)-incorrect (no)correct adverse (or)incorrect omit - environmental effect seconded by John Vadney ALL IN FAVOR CARRIED 4(four)AYES 0(zero)NAYS.


Nancy Deitch made a motion to schedule a Public Hearing on May 17, 2006 at 7:45 pm seconded by John Vadney. ALL IN FAVOR CARRIED 4(four)AYES 0(zero)NAYS.

OLD BUSINESS

ZONING LAW MODIFICATIONS


The board addressed the continuation of the possible modifications of the Town of Mayfield Zoning Law.

The board addressed a further revision to Local Law 2 of 2005 Section 202 – Definitions HOME OCCUPATIONS  to the preamble second paragraph is to eliminate the word “including” which precedes the word noise.  ALL IN FAVOR CARRIED 4(four) AYES 0(zero) NAYS.


The board revisited the change to Local Law 2 of 2005 Section 301-13: C-1 which is to allow residential 1-R1 and residential 2 -R2 applications With Site Plan Review in

commercial zones, and further amend to exclude number 5 and 6 under Section 301-4:R-2 Site Plan Uses, Number 5 being Mobile Home Parks and Number 6 being RV Parks.

PLANNING BOARD ACTION

A motion made by Nancy Deitch to amend the change previously made to Local Law 2 of 2005 Section 301-13:C-1 by adding to exclude number 5 – Mobile Home Parks and number 6 – RV Parks of Section 301:4-R-2 Site Plan Uses seconded by John Vadney          ALL IN FAVOR CARRIED 4(four)AYES 0(zero)NAYS.


Item number 6 Local Law 2 of 2005 Section 402: Art Dahl discussed Additional Area Regulations H: Walls Fences and Hedges as they pertain to distance from lot lines with Sean Geraghty Fulton County Planning Board.  The board addressed this issue and came to the conclusion to allow the law to stand as it reads.

PLANNING BOARD ACTION

A motion made by Marilyn Salvione to make no change to Section 402 seconded by John Vadney ALL IN FAVOR CARRIED 4(four)AYES 0(zero)NAYS.


Item number 7 Local Law 2 of 2005 Subsection 301:11 Agricultural Permitted Uses, the board agreed with Mike Stewarts wording of Subsection 301:11 Agricultural Permitted Uses number 4.

PLANNING BOARD ACTION

John Vadney made a motion to accept Mike Stewarts, CEO, wording of Local Law 2 of 2005 Subsection 301-11 Agricultural Permitted Uses number 4 which reads All uses allowed in R1 and R2 and RE with exception of Mobile Home Parks and continue with the boards modifications of Subsection 301:11 number 4 which was addressed in April 5, 2006 minutes, which reads,  If Site Plan Review is required for such use in R-1,R-2, or R-E Site Plan Review shall also be required in agricultural zones.   Seconded by Marilyn Salvione. ALL IN FAVOR CARRIED 4(four)AYES 0(zero) NAYS.


Item number 8 Local Law 2 of 2005 Subsection 301-4:R2 Site Plan Uses.  A discussion was held and the board finds it necessary to remove number 8 – Two Mobile Homes.

PLANNING BOARD ACTION

A motion made by Marilyn Salvione to remove (omit) number 8 –Two Mobile Homes-of Local Law 2 of 2005 Subsection 301-4:R2 Site Plan Uses from the following uses under R2.  Seconded by John Vadney. ALL IN FAVOR CARRIED 4(four)AYES 0(zero)NAYS.


Item number 9 Local Law 2 of 2005 Section 705 B Density The board feels the amendment Mike Stewart, CEO, has offered would make this section easier to understand.

PLANNING BOARD ACTION

A motion made by Marilyn Salvione and seconded by Nancy Deitch to add after gross acreage required for the proposed number of lots for the recommended change to Section 705 B ALL IN FAVOR CARRIED 4(four)AYES 0(zero)NAYS.

Items number 10 Local Law 2 of 2005 Section 803 Nonconforming Structures C-Changes:  The board’s proposed change to this law is to replace the word building with the word structures, and keep only the first sentence to this law.

PLANNING BOARD ACTION

A motion made by John Vadney and seconded by Nancy Deitch to amend this law by a change of the word building found in the first sentence to the word  structures and omit the rest of the paragraph so that the law will read- A non conforming structure may not be changed except to a conforming use.  ALL IN FAVOR CARRIED 4(four)AYES 0(zero)NAYS.


Item number 11 Local Law 2 of 2005 Section 202 Definitions Number 50-Manufactured Home:  The board held a discussion on this definition.  Marilyn Salvione will look into this definition further.  Tabled for the next meeting.


Item number 12 Local Law 2 of 2005 Section 803 Nonconforming Structures F-Restoration.  The board’s suggestion on this law is to make no change.


Item number 13 Section 504 B-Signs. B Signs in R-1, R-2, R-E, L1 Districts:  The board agrees there is an issue here but will not address at this time.


Item number 15  Mike Stewarts, CEO, Do you want to consider setting a limit on the age of a singlewide or doublewide that can be placed in the Town such as nothing older than 20 years? Tabled for the next meeting.


Item number 16 Local Law 2 of 2005 Section 301 Zoning Districts Subsection 301-6: R-E Site Plan Uses Number 5 and Subsection 301-10:L-2 Site Plan Uses Number 5.  Mr. Dahl will confer with Sean Geraghty of Fulton County Planning Board on this issue.  Tabled for the next meeting.
