At a regular meeting of the Mayfield Planning Board, Town of Mayfield, Fulton County, New York, held on Wednesday April 19, 2006 at the Mayfield Municipal Complex, 28 North School Street at 7:00 pm there were

Chairman Arthur Dahl called the meeting to order at 7:00 pm.


APPROVAL OF MINUTES-A motion was made by John Vadney and seconded by Nancy Deitch to approve the minutes of April 5, 2006 as submitted. Carried 4 (four) AYES 0(zero) NAYS.

Robert Cooper entered the meeting at 7:20 pm.


FIRST ORDER OF BUSINESS:

Dunkin’ Donuts Proposal: Various issues and their effects were discussed as follows: Correction of a tributary flowing into the Kennyetto Creek, Update on traffic report, DEC water quality, wetlands relocation.

The board has received an update report on the traffic study.

The board received copies of letters from NYS Office of Park, Recreation and Historic Preservation stating No Impact.

Copy of letter from United States Fish and Wildlife Service.

Copy of letter from New York Sate Department of Environmental Conservation stating no record of known occurrences of rare or state-listed animals or plants, significant natural communities, or other significant habitats, on or in the immediate vicinity of your sites.

Copy of letter from United States Department of the Interior Fish and Wildlife Service stating no federally listed or proposed endangered or threatened species under our jurisdiction are known to exist in the project impact area.

Copy of letter from Department of Health stating concern in reference to separation of well and septic.

The Department of Environmental Conservation is requiring a leach permit, a copy of said application for the leach permit along with Stormwater Pollution Prevention Plan will be filed with the proposal.  A permit from Department of Transportation is pending, contingent on DOT ongoing corridor study of intersection State Highway 30 and State Highway 29.

After viewing the traffic pattern plans, Art Dahl expressed some concern with safety and semi tractor trailers parking on side of road blocking the view of exiting traffic from

the proposed establishment.  The Planning Board requests a sign be placed, upon approval from DOT, to read to this effect Trucks No Parking on side of road.  Applicant agreed.


The SEQR – Full Environmental Assessment Form was discussed and completed.  John Vadney made a motion for issuing a NEGATIVE DECLARATION (No Impact) to the SEQR, since the only adverse effect is a small to moderate impact with construction on land where the depth to the water table is less than 3 feet.  The impact will be mitigated by project change, fill to be brought in. There will be a small to moderate impact on construction in a designed floodway; this will be mitigated by stormwater management.  There will be a potential large impact on non-protected existing water.  This will be addressed by original pond being eliminated and replaced by new wetlands.  There will be a small to moderate impact on altering drainage flow or patterns or surface water run off.  This will be mitigated by stormwater management.  The impact on transportation will be small to moderate.  The traffic study indicates location can accommodate increased traffic flow. Nancy Deitch seconded ALL IN FAVOR CARRIED 5(five) AYES 0(zero) NAYS.


A motion was made by Nancy Deitch and seconded by John Vadney to schedule a Public Hearing for Dunkin’ Donuts on May 17, 2006 at 7:15 pm.  Adjacent property owners will be notified of the Public Hearing. All IN FAVOR  CARRIED 5(five) AYES 0(zero) NAYS.


NEW BUSINESS:    


PRE-APPLICATION - PETRELIA

Anthony and Jennifer Petrelia submitted a pre-application for subdivision.  The property is located at 163 Handy Road Mayfield, NY.  Tax Parcel # 88-1-40.  They are proposing to subdivide a 12.6 acre lot and build a house.  They have obtained a permit form A.P.A.  The parcel has not been subdivided in the last 5 years.


PLANNING BOARD ACTION

Marilyn Salvione made a motion authorizing the Chairman of the Planning Board to initiate a letter declaring the proposed action exempt, upon receipt of survey confirming lot size is 150 feet road frontage and 150 feet at all points.  The proposed subdivision is exempt from regulation by the Planning Board under APPENDIX A PARAGRAPH DD of the Subdivision Regulations.  Nancy Deitch seconded.  ALL IN FAVOR CARRIED 5(five) AYES 0(zero) NAYS.


SITE PLAN REVIEW - HAUGAARD

Robert Haugaard submitted a Site Plan Application for an addition to his video store located at 177 Co Hwy 155 Broadalbin, NY.  Tax parcel # 137.4 .28. The proposed addition will be 800 square feet.  The Planning Board advised him a site that is

located on a State or County road requires comment by the County Planning Board.  Applicant was given short form environmental assessment review form.  Prior to the next

meeting the short form environmental assessment review will be completed and a Public Hearing will be held.   


PLANNING BOARD ACTION

The Planning Board will forward the proposal to the County Planning Board.  A motion made by John Vadney to schedule a Public Hearing on May 17, 2006 at 8:00 pm seconded by Nancy Deitch. ALL IN FAVOR CARRIED 5(five) AYES 0(zero) NAYS.


SITE PLAN REVIEW – GRECO


Marty Greco submitted a Site Plan Application for a small commercial retail and office.  He is proposing 3 buildings with a park (open area).  The property is located on old Route 30 AKA Riceville Rd, between Mayfield Historical Society and Second Ave.  Tax Parcel # 103.04-1-16.111.  The Planning Board questioned Mr. Greco and Mr. Huckans about their proposed plans.  They are proposing 2 phases over a span of approximately 3 years consisting of a sales office for the business of Adirondack Tradition Daniel Boone Log Homes and 2 buildings for renting to small retail stores with a park (open area).  The Planning Board advised him a site that is located within 500 feet of State Road requires comment by the County Planning Board.  Some suggestions were given to the applicant on describing the phases with a one page written description on how the plan would be implemented.  The Planning Board will consider approval of Phase I being construction of office building and placement of statute (the Big Man), and then consider PhaseII to be the remaining of the project, and not actually give formal consideration yet to Phase II until we have seen the more complete plans for these buildings.

The applicant is to supply the Planning Board with the names and addresses of all adjoining property owners for notification of Public Hearing.  The Short Form Environmental Assessment Form is to be completed and a Public hearing held at the next meeting.


PLANNING BOARD ACTION    

The Planning Board will forward the site plans to the County Planning Board.  A motion made by Marilyn Salvione to schedule a Public Hearing for Phase I on May 17, 2006 at 8:15 pm. Seconded by Nancy Deitch. ALL IN FAVOR CARRIED 5(five) AYES 0(zero) NAYS.


PRE-APPLICATION – WEMPLE


Judith Wemple submitted a pre-application for a subdivision. The property is located at 165 Dennie Rd, Mayfield NY.  Tax Parcel # 88-1-26-22.  She is proposing to subdivide 1 acre as a gift to her daughter.  A discussion was held on the present proposal being less then 150 feet in width.  Alternatives were addressed to make the width at least 150 feet

with 150 feet road frontage and 1 or more acres and thereby being exempt from the subdivision regulations.


PLANNING BOARD ACTION
