ELECTED SALARIES FOR 2009

One motion by Councilman Argotsinger seconded by Councilman Ruliffson the following resolution was ADOPTED 5 AYES (McLain, Argotsinger, Humphrey, Putman, Ruliffson) 0 NAY

RESOLVED for the Town Board, Town of Mayfield to establish the annual salaries for the following elected positions:

RESOLVED that the Town Board of the Town of Mayfield make the following appointments to the Planning Board. Appoint Robert Phillips to the Planning Board effective January 1, 2009 to December 31, 2013.

RESOLVED that the Town Board of the Town of Mayfield appoints Cheryl Gifford as Planning Board Clerk at the rate of $13.10 per hour.

RESOLUTION # 9

SET SALARY FOR APPOINTED OFFICIALS

On motion by Councilman Argotsinger seconded by Councilman Ruliffson the following resolution was ADOPTED 5 AYES (McLain, Argotsinger, Humphrey, Putman, Ruliffson) 0 NAY

RESOLVED that the Town Board set a salary rate for the following appointed officials:

 

Assessment Review Board members of $150.00 per individual up to 15 hour limit, with an hourly rate of $10.00 per hour after a total of 15 hours.

Code Enforcement Officer - Michael Stewart as Code Enforcement Officer at a salary of $34,928.00 annually paid bi-weekly.

 

 

 

 

RESOLUTION # 10

DEPUTY CLERK APPOINTMENTS AND RATE OF PAY

RESOLVED that the Town Board approves the appointment of Cheryl Gifford as Deputy Clerk at a rate of $13.10 per hour

DEPUTY CLERK APPOINTMENT AND RATE OF PAY

On motion by Councilman Putman seconded by Councilman Argotsinger the following resolution was ADOPTED 5 AYES (McLain, Argotsinger, Humphrey, Putman, Ruliffson) 0 NAY

RESOLVED that the Town Board approves the appointment of Virginia Hall as Deputy Clerk, Deputy Registrar and Deputy Records Management Officer at $10.92 per hour.

 

RESOLUTION # 12

MISCELLANEOUS APPOINTMENTS

On motion by Councilman Humphrey seconded by Councilman Argotsinger the following resolution was ADOPTED 5 AYES (McLain, Argotsinger, Humphrey, Putman, Ruliffson) 0 NAY

RESOLVED that the Town Board, Town of Mayfield, establish the following:

           

Mileage rate .50 per mile for all town employees to be submitted on a monthly basis by voucher for payment      

Meal Expenses for conferences according to New York State guidelines on closest city or town.

Official Depositories   NBT bank

Authorize the Highway Superintendent to spend up to $2,000 without prior Highway Committee approval.

Authorize the CEO, Assessor, Town Clerk, and Town Justices to spend up to $100.00 without prior Town Board approval.

           

Authorize the Supervisor to file with the Town Clerk a copy of Annual Financial Report by February 29, 2009 at which time report is also required to be filed with NYS Comptrollers Office.

     Direct the Supervisor:       

            1. To invest in short-term Certificates of Deposit.

            2. Forward payment for utilities and health program upon receipt to defray finance charges.

            3. Forward monies to Fire District #2 upon receipt from Tax Collector on 2009 Tax Levy.

 

RESOLUTION # 13

APPOINT ATTORNEY FOR TOWN

On motion by Councilman Ruliffson seconded by Councilman Putman the following resolution was ADOPTED 5 AYES (McLain, Argotsinger, Humphrey, Putman, Ruliffson) 0 NAY

RESOLVED that the Mayfield Town Board appoints Carmel Greco, Esquire as attorney for the Town of Mayfield in accordance with the contract authorized on January 16, 2002, at a salary of $10,600.00 for 2009.

 

 

RESOLUTION # 14

APPOINT TOWN HEALTH OFFICER

On motion by Councilman Ruliffson seconded by Councilman Humphrey the following resolution was ADOPTED 5AYES (McLain, Argotsinger, Humphrey, Putman, Ruliffson) 0 NAY

RESOLVED that the Mayfield Town Board appoint Dr. Mayer as Health Officer for the town effective January 1, 2009 to December 31, 2009 at an annual salary of $600.00 to be paid on or about December 15th of each year.

RESOLUTION # 15

ESTABLISH OFFICIAL NEWSPAPER

On motion by Councilman Humphrey seconded by  Councilman Argotsinger  the following resolution was ADOPTED 5AYES (McLain, Argotsinger, Humphrey, Putman, Ruliffson) 0 NAY

RESOLVED to that the Mayfield Town Board establishes the Leader Herald as the official newspaper for the Town.

 

 

RESOLUTION # 16

RETURN CHECK FEE

On motion by Councilman Ruliffson seconded by Councilman Humphrey the following resolution was ADOPTED 5 AYES (McLain, Argotsinger, Humphrey, Putman, Ruliffson) O NAY

RESOLVED that the Town Board of the Town of Mayfield imposes a $30.00 charge on returned checks issued to the Town of Mayfield.

 

RESOLUTION # 17

ADOPT POLICY MANUAL FOR 2009

On motion by Councilman Ruliffson seconded by Councilman Humphrey the following resolution was ADOPTED 5 AYES (McLain, Argotsinger, Humphrey, Putman, Ruliffson) 0 NAY

RESOLVED that the Town Board of the Town of Mayfield adopts the Plan and Policy Manual (Fixed Assets, Sexual Harassment, Procurement Policy, Investment Policy, Code of Ethics, Affirmative Action Plan & American with Disabilities Plan, Highway Employee License Policy) for 2009 as filed with the Town Clerk.

 

RESOLUTION # 18

 APPOINT OF COUNCILMAN PUTMAN AS SEXUAL HARASSMENT OFFICER FOR THE TOWN

On motion by Councilman Argotsinger seconded by Councilman Ruliffson the following resolution was ADOPTED 5AYES (McLain, Argotsinger, Humphrey, Putman, Ruliffson) 0 NAY

RESOLVED that the Mayfield Town Board appoints Councilman Putman as sexual harassment officer for the town.

The Supervisor reminded the Town Board that issues of concern would be reviewed by committee and then reported back to the Board for action to be taken.  The Supervisor, as exofficio, may sit on all committees.  All matters regarding personnel would be conducted by the entire Board.

ANNUAL INVENTORY

On motion by Councilman Argotsinger seconded by Councilman Ruliffson the following resolution was ADOPTED 5 AYES (McLain, Argotsinger, Humphrey, Putman, Ruliffson) 0 NAY

The Annual Inventory will be reviewed by the Property Control Committee, verified by each department head and returned to the Board for approval by March 20.  A copy would be filed with the Town Clerk for record and a copy forwarded to Lita Hillier for bookkeeping.

 

RESOLUTION #21

ESTABLISH SALARY FOR PART-TIME LABORERS WITH SANITATION EMPLOYEES

On motion by Councilman Ruliffson seconded by Councilman Humphrey the following resolution was ADOPTED 5 AYES (McLain, Argotsinger, Humphrey, Putman, Ruliffson) 0 NAY

RESOLVED that the Mayfield Town Board establishes an hourly rate for Part-time CDL employees with Sanitation Department at $15.66 per hour and Part-time employees without a CDL at $13.11 per hour effective with the bi-weekly Payroll 1- 05-2009

 

RESOLUTION # 22

APPOINTMENT OF DEPUTY HIGHWAY SUPERINTENDENT

On motion by Councilman Ruliffson seconded by Councilman Humphrey the following resolution was ADOPTED 5 AYES (McLain, Argotsinger, Humphrey, Putman, Ruliffson) 0 NAY

Highway Superintendent Mel Dopp appointed James Blowers as Deputy Highway Superintendent at a salary of $525.00 per year, paid annually on 11/27/09.

 

RESOLUTION # 23

ESTABLISH SALARY FOR PART-TIME LABORERS WITH HIGHWAY DEPARTMENT

On motion by Councilman Ruliffson seconded by Councilman Putman the following resolution was ADOPTED 5 AYES (McLain, Argotsinger, Humphrey, Putman, Ruliffson) 0 NAY

 

RESOLVED that the Mayfield Town Board establishes an hourly rate for part-time Laborers with Highway Department at a rate of $10.73 per hour.

 

RESOLUTION # 24

ESTABLISH REDUCED SALARY FOR SUPERVISOR MCLAIN PER HIS REQUEST IN A LETTER TO THE BOARD

On motion by Councilman Ruliffson seconded by Councilman Putman the following resolution was ADOPTED 5 AYES (McLain, Argotsinger, Humphrey, Putman, Ruliffson) 0 NAY

RESOLVED that the Town Board of the Town of Mayfield approves the letter from Supervisor Alan McLain requesting his salary be reduced from the budgeted amount of $1312.50 per month.

 APPROVAL OF HEALTH INSURANCE REIMBURSEMENT

On motion by Councilman  Ruliffson seconded by Councilman  Argotsinger the following resolution was ADOPTED 5 AYES (McLain, Argotsinger, Humphrey, Putman, Ruliffson)  0 NAY

RESOLVED that the Mayfield Town Board approves reimbursement to Supervisor McLain in the amount of $341.00 per month beginning in January 2009 for health insurance benefits purchased through Fulton County to the end of the year 2009.

APPROVAL OF TRANSFER OF FUNDS

On motion by Councilman Argotsinger seconded by Councilman Putman the following resolution was ADOPTED 5 AYES (McLain, Argotsinger, Humphrey, Putman, Ruliffson) 0 NAY 

RESOLVED that the Mayfield Town Board approves the transfer of funds in the amount of $4,092.00 from A1220.1 (Supervisor's Personal Services) to A9060.8 (Health Insurance) and $4578.00 from A1220.1 (Supervisor's Personal Services) to A1220.4 (Supervisor's C.E).

TO JOIN LAWSUIT BY ADIRONDACK COUNTIES AND TOWNS AGAINST THE ADIRONDACK PARK AGENCY

On motion by Councilman Argotsinger seconded by Councilman Putman the following resolution was ADOPTED 5 AYES (McLain, Argotsinger, Humphrey, Putman, Ruliffson) 0 NAY

            Whereas, there are 3,000 lakes and ponds and 31,000 miles of rivers and streams in the Adirondacks, of which several are located on private land; and

            WHEREAS, the Adirondack Park Agency (APA) adopted new, restrictive regulations on  shoreline properties in the Adirondack Park at its meeting on November 14,2008; and

            WHEREAS, one of the new APA regulations repeals APA Act, Section 811(5), which authorized, grandfathered shoreline lot owners to  expand their homes and cabins without APA jurisdiction, provided the dwelling continued to be used as such and that no such increase or expansion would violate minimum setback requirements of the shoreline restrictions; and

            WHEREAS, the economic impact of said new prohibitions against expansion of preexisting homes and cabins in the shoreline setback would be huge; and

            WHEREAS, the recently adopted regulations also purport to expand APA jurisdiction over subdivisions involving wetlands and natural subdivisions without action by the NYS Legislature; and

            RESOLVED, That by this Resolution, the Town of Mayfield hereby authorizes joining the lawsuit, against the Adirondack Park Agency to overturn the new regulations on shoreline properties; and be it further

            RESOLVED, That the Town be and hereby is directed to transfer $1,000.00 from account A1930.4 (Judgments and Claims)

 

RES# 28

OPOSSING GOV. PATTERSON AMENDING SECTION 544 OF THE REAL PROPERTY TAX LAW

On motion by Councilman Putman seconded by Councilman Humphrey the following resolution was ADOPTED 5 AYES (McLain, Argotsinger, Humphrey, Putman, Ruliffson) 0 NAY

RESOLVED that the Mayfield Town Board oposses Governor Patterson's amending of section 544 of the real property tax law.

 

BUILDING  INSPECTOR- Mike Stewart CEO submitted his monthly report which included 10 permits issued for the month, also gave an update on the Ernie Fancher property.

 

HIGHWAY  SUPERINTENDENT REPORT- Mel Dopp Highway Superintendent reported the new tractor is in, and had received a quote from Bell engineering for the School Street bridge. It was suggested that the highway committee and Mel meet to review the quote; school was out of gas, highway committee and Mel will meet to go over specs for the new truck; also questioned giving sanitation workers holiday pay. A discussion followed

AUTHORIZE SANITATION WORKERS TO RRECEIVE HOLIDAY PAY

On motion by Councilman Argotsinger seconded by Councilman Ruliffson the following resolution was ADOPTED 4 AYES (McLain, Argotsinger, Humphrey, Ruliffson ) 1 NAY (PUTMAN)

RESOLVED that the Mayfield Town Board authorizes the sanitation workers receive holiday pay for 7 hours if the holiday falls on a normal workday that they would normally work 7 hours and receive 4 hours of pay if it falls on a normal 4 hour work day.

 

SUPERVISOR'S REPORT- Supervisor McLain reported that the annual historian‘s report was submitted, and it was noted 2009 will be Town Historian Betty Tabor's 25th years as Historian. Mr. Clifford Sweet inquired about a senior discount from time Warner cable; also has received estimates on the shared highway storage project.

 

The Town Clerk's report was submitted with fees collected in the A account 345.40,  B account 9895.00

RESOLVED that the Mayfield Town Board approves the payment of vouchers in the following accounts

On motion by Councilman Ruliffson seconded by Councilman Humphrey the following resolution was ADOPTED 5 AYES ( McLain, Argotsinger, Humphrey, Putman, Ruliffson) 0 NAY

RESOLVED  that the Mayfield Town Board approves to amend the 2008 Highway Townwide Budget to raise revenues and appropriations to use anticipated excess 4th quarter sales tax  distribution toward snow removal expenses incurred as follows:
