A regular meeting of the Mayfield Town Board was held on Thursday, December 18, 2008 at the Mayfield Municipal Complex 28 North School Street. The meeting was called to order at 7:00 pm and opened with the Pledge of Allegiance led by Supervisor Alan McLain.

PUBLIC- No one spoke at this time.

 

RES# 160 ADOPT LOCAL GOVERNMENT EFFICIENCY IMPLEMENTATION GRANT PROGRAM FOR 2008-2009 PROGRAM YEAR

On motion by Councilman Putman seconded by Councilman Humphrey the following resolution was ADOPTED 5 AYES (McLain, Argotsinger, Humphrey, Putman, Ruliffson) 0 NAY

WHEREAS, the Village of Mayfield, in conjunction with the Town of Mayfield, has proposed the design and construction of a new Department of Public Works  Shared Highway Garage and Salt Storage Facility  Project, and

WHEREAS, the Village of Mayfield and Town of Mayfield desire to submit a grant application with the Local Government Efficiency Implementation Grant program to obtain funding to prepare design plans and bid specifications, as well as construct this Public Works Shared Highway Garage and Salt Storage Facility, Now therefore be it

RESOLVED, that Harvey Jon Hart,  Village of Mayfield Mayor, be and is hereby authorized and directed to sign and submit a grant application under the 2008-2009 Local Government Efficiency Implementation Grant program to obtain grant funds to design and construction of a new Department of Public Works Shared Highway Garage and Salt Storage Facility, and be it further

RESOLVED, that the Village of Mayfield be and is hereby authorized and directed to be the Lead Applicant on this application with the Town of Mayfield to serve as the co-applicant, and be it further

RESOLVED, that the grant application shall request $400,000 in grant funds to help pay for the cost or this  project and that the 10% required local share shall be paid and shared equally by the Village of Mayfield and Town of Mayfield using reserve funds available from both municipalities, and be it further

RESOLVED, that Harvey Jon Hart, Village of Mayfield Mayor, be and is hereby authorized and directed to enter into an Intermunicipal Agreement with the Town of Mayfield regarding the design, construction and operation of this proposed Department of Public Works Shared Highway  Garage and Salt Storage Facility, and be it further

RESOLVED, that certified copies of this resolution be forwarded to the Village Mayor, Village Board, Village Attorney, Town Supervisor, Town Board and Town Attorney.

 

BUILDING INSPECTOR- Mike Stewart CEO submitted his monthly report which included 17 permits issued and he requested and was granted vacation from December 22 through December 29th from Supervisor McLain.

 

SUPERVISOR REPORT- The speed limit reduction request for Woods Hollow Road was denied by NYS DOT.  Work on the post office is continuing and should open in February 2009. Supervisor McLain complimented the highway department on the roads.

 

HIGHWAY SUPERINTENDENT REPORT - Mel Dopp Highway Superintendent reported that Fulton County Highway Superintendent Mark Yost is working on securing monies for the School Street Bridge.  Beech Street project is ready to go, the new tractor should be delivered the end of the month, the skating rink is open, and the Highway employees have been around the town plowing 27 times so far this season.

Eden Lane has been requested to be taken over as a town road. Mr. Dopp will send them the requirements for the town to take over a road.

 

RES# 161 OPEN PUBLIC HEARING FOR GRANTING TO QUALIFIED COLD WARD VETERANS A REAL PROPERTY TAX EXEMPTION

On motion by Councilman Putman seconded by Councilman Argotsinger the following resolution was adopted 5AYES (McLain, Argotsinger, Humphrey, Putman, Ruliffson) 0 NAY

RESOLVED that the Mayfield Town Board approves to open the public hearing at 7:15PM for the scheduled public hearing.

 

The Town Clerk read the certification of publication.

The public hearing was left open and the town continued with town business.

Supervisor McLain reported on the final bill for 2008 for the town's part of the rent.

Supervisor McLain reported that he had sent the final bill to the post office for the former Village Hall.

The agreement with Fraser Associates has been reviewed by the Town Attorney.

 

RES# 162 AUTHORIZE SUPERVISOR TO SIGN CONTRACT WITH FRASER ASSOCIATES

On motion by Councilman Putman seconded by Councilman Humphrey the following resolution was DOPTED 4 AYES (McLain, Argotsinger, Humphrey, Putman, Ruliffson) o NAY

RESOLVED that the Mayfield Town Board authorizes Supervisor McLain to sign the contract agreement with Fraser Association.

 

RES# 163 CLOSE PUBLIC HEARING ON Proposed local law #3 of 2008

On motion by Councilman Ruliffson seconded by Councilman Putman the following resolution was ADOPTED 5AYES (McLain, Argotsinger, Humphrey, Putman, Ruliffson) 0 NAY

RESOLVED that the Mayfield Town Board approves to close the scheduled public hearing at 7:32 pm.

 

RES# 164ADOPT LOCAL LAW #3 OF 2008

On motion by Councilman Ruliffson and seconded by Councilman Putman the following resolution was ADOPTED by roll call vote

RESOLVED that the Mayfield Town Board approves to adopt local law # 3 of 2008 titled GRANTING TO QUALIFIED COLD WAR VETERANS A REAL PROPERTY TAX EXEMPTION.

 

Res# 165 ADOPTION OF RESOLUTION FOR THE PURPOSE TO IMPLEMENT A REAL PROPERTY TAX EXEMPTION "SLIDING SCALE" OPTION TO THOSE PERSONS SIXTY-FIVE YEARS OF AGE OR OLDER WHO OWN REAL PROPERTY IN THE TOWN OF MAYFIELD.

On motion by Councilman Ruliffson seconded by Councilman Humphrey the following resolution was adopted BY ROLL CALL VOTE

WHEREAS, Town of Mayfield Resolution No 145 of 1993 implemented a real property tax exemption "sliding scale" option to those persons sixty-five (65) years of age or older who own real property in the Town of Mayfield, Fulton County, and

WHERAS, Mayfield resolution No 27 of 1996 amended the aforesaid Resolution as regards income limits and

WHEREAS, the  State of New York has increased the income limitations for local option tax exemptions available to senior citizens pursuant to Section 467 of the Real Property Tax Law, and

WHERAS, the Town Board of the Town of Mayfield is desirous of granting the maximum permissible tax exemption to its senior citizens, who qualify,

NOW, THEREFORE BE IT RESOLVED by the Town Board of the Town of Mayfield that, pursuant to Section 467 of the Real Property Tax Law of the State of New York, the Town Board of the Town of Mayfield hereby adopts the following schedule of annual income limitations for senior citizens allocable to Town of Mayfield Real Property Taxes, effective immediately:

BE IT FURTHER RESOLVED, that for the purposes of computing income pursuant to the provisions hereof, income shall not include veteran's disability  compensation as defined in Title 38 of the United States Code, and

BE IT FURTHER RESOLVED, that the notice provisions of Section 467 (4) of the Real Property Tax Law may be met by a notice or legend sent on or with each tax bill to each person owning residential real property in the Town which reads as follows: YOU MAY BE ELIGIBLE FOR SENIOR CITIZEN TAX EXEMPTIONS.  SENIOR CITIZEBS HAVE UNTIL March 1, 2009 to apply for such exemptions. Supervisor McLain thanked all the people who helped with the holiday gathering, and especially Town Clerk Dorothy Hart who organized the event.

The town clerks report was submitted with fees collected in the A account 109.03 Decals 6.80 B account 1507.50

 

RES#166 APPROVE $100.00 PETTY CASH FOR TAX COLLECTOR

On motion by Councilman Putman seconded by Councilman Argotsinger the following resolution was ADOPTED 5 AYES (McLain, Argotsinger, Humphrey, Putman, Ruliffson) 0 NAY

RESOLVED that the Mayfield Town Board approves 100.00 for petty cash for the tax collector to be returned April 1st.

Mel Dopp Highway Superintendent asked if the Village Employees can load their own truck. A discussion followed regarding the insurance concerns with the decision to be up to the Highway Superintendent.

 

A discussion was held on the sanitation department getting paid for some of the holidays.  More discussion will take place at the January 8th meeting.

 

 

 

RES# 170 AUTHORIZE HIGHWAY SUPERINTENDENT TO CONTACT BELL ENGINEERING

On motion by Councilman Ruliffson seconded by Councilman Putman the following resolution was ADOPTED 5 AYES (McLain, Argotsinger, Humphrey, Putman, Ruliffson) 0 NAY

RESOLVED that the Mayfield Town Board approves to authorize Highway Superintendent Mel Dopp to contact Bell Engineering for a scope of work for the School Street Bridge.

 

RES# 171 AUTHORIZE  PURCHASE OF PHONE SYSTEM FROM FRONTIER

On motion by Councilman Ruliffson seconded by Councilman Humphrey the following was ADOPTED 4 AYES (McLain, Humphrey, Putman, Ruliffson) 1ABSTAIN (Argotsinger) Mr. Argotsinger abstained as his wife is employed by Frontier.

 

RESOLVED that the Mayfield town Board approves the purchase of a phone system from Frontier in the amount of $4,732.32, which was in the 2009 budget.

 

Councilman Humphrey and Councilman Argotsinger will attend a fire commissioners meeting to see if they are interested in purchasing the old system. If they are not, they will pursue other alternatives.
