A regular meeting of the Mayfield Town Board was held on Thursday, August 21, 2008 at the Mayfield Municipal Complex 28 N School Street. The meeting was called to order at 7:00 PM by Supervisor Alan McLain and opened with the Pledge of Allegiance and a moment of silence for Ivan Van Nostrand who served as a town councilman from 1980-1983 and also worked as an MEO for the Highway Department.

PUBLIC- No one spoke at this time.

 

BUILDING INSPECTOR REPORT- Mike Stewart CEO submitted his monthly report which included 23 permits issued.

 

ASSESSOR REPORT- Kathi Hillock submitted her monthly report.

 

HIGHWAY SUPERINTENDENT REPORT- Mel Dopp Highway Superintendent submitted his monthly report which included trees down on Riceville Road, paving by Empire has been done, more roads that he wishes to pave include Red Bunch, Town Road & Sand Hill Road, needs new tractor for mowing, a different bucket truck, new plow has arrived, 2 trucks were in the parade and someone has been stealing fuel from the trucks and he would like to see about getting a security camera.

 

RES# 100 OPEN PUBLIC HEARING FOR PROPOSED LOCAL LAW #2 OF 2008

On motion by Councilman Humphrey seconded by Councilman Putman the following resolution was ADOPTED 4 AYES (McLain, Argotsinger, Humphrey, Putman) 0 NAY

RESOLVED that the Mayfield Town Board approves to open the scheduled public hearing at 7:15PM.

The certification of the public hearing was read by Dorothy Hart, Town Clerk.

 

Joseph Ruggeri questioned what the proposals are and why they didn't zone the front part of his property one way and the back part something else.

Doug Kampfer stated that if a parcel is re-zoned from an agricultural zone he feels you can't get an Ag exemption. Councilman Putman explained that property which is in the county's Ag Zone would not be changed by zoning.

Jane Ruggeri questioned why we can't just change parcel that was agreed upon and leave the rest alone.

Alfred Lowry questioned why they were zoned industrial now when they have been residential. Also asked if regulation regarding how close they can be to private individual.

Roger Barnowski questioned on commercial property in Vails Mills all of the neighbors are residential.

Ronald Hoyt stated he has a vacant lot on Co Hwy 155 and questioned if in the future can put a double wide on it.

Mike Stewart CEO explained how zoning works.

Mrs. Lowry questioned if the town board has the right to vote on the residential zoning change to an industrial zone.

Scott MacLauchlin stated he feels the re-zoning in this amendment is great for the area.

 

RES# 101 CLOSE PUBLIC HEARING

On motion by Councilman Humphrey seconded by Councilman Argotsinger the following resolution was ADOPTED 4 AYES (McLain, Argotsinger, Humphrey, Putman) 0 NAY

RESOLVED that the Mayfield Town Board approves to close the public hearing on proposed local law #2 of 2008.

 

RES# 102 APPROVE LOCAL LAW #2 OF THE YEAR 2008

On motion by Councilman Humphrey seconded by Councilman Argotsinger the following resolution was ADOPTED by Roll Call Vote 4 AYES 0 NAY 1 ABSENT (Ruliffson)

RESOLVED that the Mayfield Town Board approves the adoption of local law #2 of the year 2008 amending Local Law No.2 of the year 2005 (zoning Law)

 

Highway Superintendent  Dopp explained an agreement he was interested in from Graiger for hoses. Also he had met with an engineer for a hydraulic study on Beech Street.

Supervisor McLain thanked Mel and the highway employees for cleaning the trucks to be parade ready and donating money with him for candy for the Bannertown parade.

 

SUPERVISOR REPORT- Supervisor McLain reported that the beach will be closing on August 22nd as the life guards are all returning to college. It was decided to leave the gate open so people could enjoy the picnic area and we will put up no swimming signs,

Insurance renewal went up $104.00 due to a new vehicle and the town having more road mileage than previous years.  A discussion was held on the ice & snow contract.

 

 

RES#103 TABLE ICE & SNOW CONTRACT

On motion by Councilman Argotsinger seconded by Councilman Humphrey the following resolution was ADOPTED 3 AYES (McLain, Argotsinger, Putman) 1 NAY (Putman) 1 ABSENT (Ruliffson)

RESOLVED that the Mayfield Town Board approves to table the ice & snow contract until more information is available.

 

RES# 104 AUTHORIZE JUDGES TO APPLY FOR GRANT

On motion by Councilman Argotsinger seconded by Councilman Putman the following resolution was ADOPTED 4 AYES (McLain, Argotsinger, Humphrey, Putman) 1ABSENT (Ruliffson)

RESOLVED that the Mayfield Town Board authorizes the town justices to apply for a Justice Court Assistance Program grant up to the maximum amount available for Town Court.

 

Budget packets need to be returned by September 20th.

 

RES# 105 ACCEPT REVENUE RECOVERY SERVICE AGREEMENT

On motion by Councilman Putman seconded by Councilman Argotsinger the following resolution was ADOPTED 4 AYES (McLain, Argotsinger, Humphrey, Putman) 1 ABSENT (Ruliffson)

            WHEREAS, the Broadalbin- Kennyetto Fire Company, Inc. is seeking permission to enter into a Revenue Recovery Service Agreement with Certified Ambulance Group, Inc. to collect funds for the services rendered on certain tasks performed at an automobile accident scene, and

            WHEREAS, to be in compliance with State and Local guide lines, the Broadalbin- Kennyetto Fire Company, Inc. is required to have authorization from all the fire districts which the said Fire Company services in order to enter into such agreement, and

            WHEREAS, the Town of Mayfield Town Board commends the Broadalbin- Kennyetto Fire Company, Inc for seeking different revenue sources other than taxpayers dollars,

            NOW, THEREFORE, BE IT RESOLVED that the Town of Mayfield hereby gives its authorization to permit the Broadalbin- Kennyetto Fire Company, Inc. to enter into a Revenue Recovery Service Agreement, and it is further

            RESOLVED, that a copy of this resolution be sent to the Broadalbin- Kennyetto Fire Company, Inc., the Town of Broadalbin, the Town of Northampton, and the Village of Broadalbin.

 

Dog Control Report was submitted.

Town Clerk's Report was submitted

Supervisor McLain reported that the Sacandaga Sand Bar, formerly Dominick's Sand Bar,  is now open under the new ownership of Bill Hanka.

 

 

 

 

RES# 106 MOVE INTO EXECUTIVE SESSION

On motion by Councilman Argotsinger seconded by Councilman Putman the following resolution was ADOPTED 4 AYES (McLain, Argotsinger, Humphrey, Putman) 1 ABSENT (Ruliffson)

RESOLVED that the Mayfield Town Board approves to move into executive session at 8:35PM for the purpose of discussing the work history of an employee.

 

RES# 107 MOVE OUT OF EXECUTIVE SESSION

On motion by Councilman Putman seconded by Councilman Humphrey the following resolution was ADOPTED 4 AYES (McLain, Argotsinger, Humphrey, Putman) 1 ABSENT (Ruliffson)

RESOLVED that the Mayfield Town Board approves to move out of executive session and back into regular session at 9:35PM.

 

RES# 108 APPROVE PAYMENT OF VOUCHERS

On motion by Councilman Argotsinger seconded by Councilman Putman the following resolution was ADOPTED 4 AYES (McLain, Argotsinger, Humphrey, Putman) 1 ABSENT (Ruliffson)

RESOLVED that the Mayfield Town Board approves the payment of vouchers in the following accounts.

General Townwide    vouchers 245-272                                 $16,922.57

General Outside         vouchers 34- 35                                   $447.60

Highway Townwide   voucher 30                                          $327.50

Highway Outside        vouchers 109- 126                              $188,848.56

 

RES# 109 ACCEPT RESIGNATION OF ASSESSOR

On motion by Councilman Argotsinger seconded by Councilman Humphrey the following resolution was ADOPTED 4 AYES (McLain, Argotsinger, Humphrey, Putman) 1 ABSENT (Ruliffson)

RESOLVED that the Mayfield Town Board accepts the resignation of Kathi Hillock Assessor, effective immediately.

 

On motion by Councilman Humphrey seconded by Councilman Argotsinger the meeting was adjourned at 10:00 PM 4 AYES (McLain, Argotsinger, Humphrey, Putman) 1 ABSENT (Ruliffson)
