A regular meeting of the Mayfield Town Board was held on Thursday, July 17, 2008 at the Mayfield Municipal Complex 28 N School Street. The meeting was called to order at 7:00 PM by Supervisor Alan McLain and opened with the Pledge of Allegiance.

PUBLIC- No one spoke at this time.

 

BUILDING INSPECTOR- Mike Stewart CEO submitted his monthly report which included 18 permits issued for the month.

 

ASSESSOR- Kathi Hillock Assessor submitted her monthly report which included the final assessment roll has been filed with the town clerk as of July 1st.

 

HIGHYWAY SUPERINTENDENT- Mel Dopp Highway Superintendent submitted his monthly report which included the new mower is coming soon, the contracted paving should begin by August 1st , new signs have been put up at the beach, there are a few grants available next year for the School Street bridge, anyone interested in the adopt a highway can pick up gloves and garbage bags from the Highway Superintendent, 2 quotes have been received for the plow for the new Highway Superintendent's pickup, the hill on Blanchard Road has been cut, the easements from Huckans and Close's were discussed.

 

RES# 90 APPROVE BID FOR PLOW

On motion by Councilman Argotsinger seconded by Councilman Putman the following resolution was ADOPTED 4 AYES (McLain, Argotsinger, Putman, Ruliffson) 1 ABSENT (Humphrey)

RESOLVED that the Mayfield Town Board approves the bid for the 91/2 V Plow in the amount of $46,113.10 for T&T.

 

 

 

 

SUPERVISOR- Supervisor McLain reported that he had received word that the contractor for the Post Office plans to start work by August 1st. Also reported that work is needed to be done on Beech Street culvert this year. He stated there may be enough money left from the Bushnell Road culvert project to fund most of this project because the bids for Bushnell Road came in under budget and without any problems.

RES# 91 OPEN PUBLIC HEARING FOR OUTDOOR WOOD BOILERS

On motion by Councilman Argotsinger seconded by Councilman Ruliffson the following resolution was ADOPTED 4 AYES (McLain, Argotsinger, Putman, Ruliffson) 1 ABSENT (Humphrey)

RESOLVED that the Mayfield Town Board approves to open the scheduled public hearing at 7:15 on proposed local law #1 of 2008 Outdoor Wood Boiler Law.

 

Elizabeth Howland stated apparently her neighbor has become aware of the proposed local law as he has shut his stove off and she has been able to open her windows for the first time in 3 years.

Fred Blowers stated he has an outdoor wood boiler that provides less smoke than his neighbors using a burning barrel or an outside fireplace and feels the town should ban all outside burning.

Dawn Ryan stated she feels there should be more restrictions on outdoor wood boilers if a moratorium isn't placed on them.

Paul Chapin suggested that anyone who has an outdoor wood boiler should start off by being a good neighbor.

Sandra Riter stated she lives near an outdoor wood boiler and can't go outside in September as she has asthma and with the stove going she can't breathe.

Kathy Sieg stated she is not against the outdoor wood boilers, but stated they are not regulated by anything, and applauds this board for taking this step. Also stated that DEC is considering a law to prohibit burning of brush for farmers.

Fred Blowers stated he spent time watching his outdoor wood boiler and it only smokes for 15 minutes rather than his neighbors who have outdoor fireplaces burning.

Aaron Howland stated in favor of law, and he owns an outdoor wood boiler but sees what his parents are going through.

Don Warner stated he has a central boiler to heat his hot water and lives on a fixed income therefore he burns his 4 days a week in the summer and uses only good dry wood.

Carolyn Putman stated she thought no one was supposed to burn garbage and tires in the outdoor wood boilers. Neighbors on both sides of them have purchased stoves from them.

Erik Brooks stated he doesn't live in area but is considering drawing up plans which would include an OWB and considers us the "frontier" and doesn't want this law.

Paul Chapin suggested to Mr. Brooks to research a good stove and then be a good neighbor.

Ed Knott stated he was interested in the public comments and purchased an OWB to heat his home. In his opinion OWB is outside the town board's oath of office.

Fred Blowers questioned if OWB is put inside.

 

 

Paul Chapin stated when an OWB is put inside a building with the right stack it is considered an inside wood boiler.

William Mykel stated the board is trying to help everyone.

Richard DaCorsi questioned how much a permit costs to be able to use the OWB during the off times.

 

RES# 92 CLOSE PUBLIC HEARING ON OUTDOOR WOOD BOILERS

On motion by Councilman Argotsinger seconded by Councilman Ruliffson the following resolution was ADOPTED 4 AYES (McLain, Argotsinger, Putman, Ruliffson) 1 ABSENT (Humphrey)

RESOLVED that the Mayfield Town Board approves to close the public hearing at 7:52PM on the Outdoor Wood Boiler Law.

On motion by Councilman Ruliffson seconded by Councilman Putman the following resolution was ADOPTED by roll call vote

RESOLVED that the Mayfield Town Board approves the adoption of Local Law 1 of 2008 Outdoor Wood Boilers Law

 

RES# 94 SET PUBLIC HEARING ON PROPOSED ZONING CHANGES

On motion by Councilman Argotsinger seconded by Councilman Ruliffson the following resolution was ADOPTED 4 AYES (McLain, Argotsinger, Putman, Ruliffson) 1 ABSENT (Humphrey)

RESOLVED that the Mayfield Town Board approves to set a public hearing on the proposed zoning changes scheduled for August 21, 2008 at 7:15 PM

 

Supervisor McLain thanked Planning Board Chairman Walt Ryan and the Planning Board for all their work on the zoning changes.

Supervisor McLain reported that the beach is doing fine and many compliments have been received regarding the employees at the beach, and the new beach directors and Carl Edwards are doing a great job in running the beach and keeping it nice and clean. Many compliments also received limiting resident use only at the beach.

 

 

 

 

 

 

 

 

 

 

RES # 95 APPROVAL OF PAYMENT OF VOUCHERS

On motion by Councilman Argotsinger seconded by Councilman Putman the following resolution was ADOPTED 4 AYES (McLain, Argotsinger, Putman, Ruliffson) 1 ABSENT (Humphrey)

RESOLVED that the Mayfield Town Board approves the payment of vouchers in the following accounts

General Townwide A                         vouchers 211-244                                   $15,509.71

General Outside B                                vouchers 25-33                                    $1,715.66

Highway Outside DB                            vouchers 93-108                                  $93,811.34

 

The Town Clerk report was submitted with fees collected A fund $454.61 B fund $1140.00 Decals $8.96

 

PUBLIC/ OTHER

Carl Edwards asked permission for the Bannertown 50 plus club to use the town beach for there annual picnic on July 22nd.

 

RES# 96 ALLOW BANNERTOWN 50 PLUS CLUB TO USE BEACH

On motion by Councilman Argotsinger seconded by Councilman Ruliffson the following resolution was ADOPTED 4 AYES (McLain, Argotsinger, Putman, Ruliffson) 1 ABSENT (Humphrey)

 

RESOLVED that the Mayfield Town Board approves to allow the Bannertown 50 Plus Club to use the t own beach for their annual picnic on Wednesday July 22 starting at 12:00 noon.

 

Mel Dopp Highway Superintendent inquired about ideas for the garbage cage on Nine Mile Tree Road. Supervisor McLain suggested Mike Stewart CEO and the Highway Superintendent hold a meeting with the park owner. Mr. Dopp would like to order lime green safety shirts for the refuse workers. Board agreed to allow the purchase.

Fred Blowers requested that the refuse workers take it easy on his garbage cans

Ed Knott questioned status of former village hall and felt the town should get more than a dollar for a lease.

Supervisor McLain reported that he had received a letter back from the state regarding the roundabout and the town will need to take care of the sidewalks, and they have no plans to include the intersection of Rte 30 and Co Hwy 106 in the project at 29 and 30.  Also the county ice and salt contract will have no raises for the towns, and McLain was very disappointed since the town's expenses have risen dramatically this year.

Janet Tucci, a resident of Maple Ridge Road ( a private road ) has a concern over the town not providing services to residents on their road. She will attend a future meeting to address what they would need to do to make it a town road. McLain presented her with a copy of the specifications needed in order for the town to consider taking over a road.

Sandra Riter questioned the board on where the sidewalks will be in Vail Mills area.

William Mykel questioned the board on when the local boiler law will go into effect.

 

 

 

RES # 97 MOVE INTO EXECUTIVE SESSION

On motion by Councilman Argotsinger seconded by Councilman Ruliffson the following resolution was ADOPTED 4 AYES (McLain, Argotsinger, Putman, Ruliffson) 1 ABSENT (Humphrey)

RESOLVED that the Mayfield Town Board approves to move into executive session at 8:10PM for the purpose of a contract with an employee and requested time off.

 

RES# 98 MOVE OUT OF EXECUTIVE SESSION

On motion by Councilman Argotsinger seconded by Councilman Putman the following resolution was ADOPTED 4 AYES (McLain, Argotsinger, Putman, Ruliffson) 1 ABSENT (Humphrey)

RESOLVED that the Mayfield Town Board approves to move out of executive session and back into regular session at 8:43 PM.

 

RES# 99 APPROVE NEGATIVE DECLARATION ON SEQR

On motion by Councilman Argotsinger seconded by Councilman Putman the following resolution was ADOPTED 4 AYES (McLain, Argotsinger, Putman, Ruliffson) 1 ABSENT (Humphrey)

RESOLVED that the Mayfield Town Board approves to declare a negative declaration on the environmental SEQR form on the amendment to the Zoning law.

 

On motion by Councilman Ruliffson seconded by Councilman Putman the meeting was adjourned at 9:00 PM 4 AYES (McLain, Argotsinger, Putman, Ruliffson) 1 ABSENT (Humphrey).
