The Mayfield Town Board met on Thursday, June 19, 2008 at the Mayfield Municipal Complex 28 North School Street, Village of Mayfield. The meeting was called to order at 7:00 PM by Supervisor McLain and opened with the Pledge of Allegiance.

 

PRESENT:

Richard Argotsinger, Councilman

OTHERS PRESENT: Betty Tabor Historian, Attorney Greco, Mel Dopp Highway Superintendent, Myrna Hallenbeck, Mike Stewart CEO, Aaron Howland, Bill Guido, Jim Cownie, Geoffrey Brooks, Kathi Hillock Assessor, Ron Holland, Mrs. Holland. James Nellis, Patricia Nellis, Kayleigh Karutis Leader- Herald, Carla Kolbe Sacandaga Express

 

PUBLIC- Jim Cownie thanked the town board and the fire district for the use of the building for AARP to use to do the tax returns.

Bill Guido thanked the town board and the highway superintendent for all the work on the Bushnell Road Bridge project.

Geoffrey Brooks made a presentation on annexation of property on Bellen Road. They would like to annex property into the Village of Broadalbin.

 

RES# 80 Open scheduled public hearing for SBL 45.3-1-31 at 7:15

On motion by Councilman Putman and seconded by Councilman Ruliffson the following resolution was ADOPTED 4 AYE (McLain, Argotsinger, Humphrey, Putman, Ruliffson) 0 NAY

 

RESOLVED that the Mayfield Town Board authorizes to open the scheduled public hearing at 7:15PM for property located at 887 Co Hwy 123 SBL# 45.3-1-31 to declare this building unsafe.

The certification of publication was read by Dorothy Hart, Town Clerk.

 

Ron Holland who has property next door to this questioned what part of the property was unsafe.

 

The public hearing was left open and the town continued with town business.

 

A discussion was held on the proposed annexation of property on Bellen Road.

 

RES#81 CLOSE PUBLIC HEARING FOR SBL 45.3-1-31

On motion by Councilman Argotsinger and seconded by Councilman Putman the following resolution was ADOPTED 4 AYES (McLain, Argotsinger, Humphrey, Putman, Ruliffson) 0 NAY

 

RESOLVED that the Mayfield Town Board approves to close the public hearing for SBL#45.3-1-31 for property located at 887 Co Hwy 123 at 7:29 PM.

 

RES# 82 OPEN SCHEDULED PUBLIC HEARING FOR SBL # 45.3-1-30

On motion by Councilman Ruliffson and seconded by Councilman Argotsinger the following resolution was ADOPTED 4 AYES (McLain, Argotsinger, Humphrey, Putman, Ruliffson) 0 NAY

 

RESOLVED that the Mayfield Town Board authorizes to open the scheduled public hearing scheduled for 7:30 PM on SBL#45.3-1-30 for property located at 885 Co Hwy 123 in the Town Of Mayfield to declare this building unsafe.

The certificate of publication was read by Dorothy Hart Town Clerk.

James Nellis, who resides across the road from this property, inquired what the next step is as the property looks like a disaster.

 

RES# 83 APPROVE ANNEXATION FOR MURPHY PROPERTY

On motion by Councilman Argotsinger seconded by Councilman Putman the following resolution was ADOPTED by roll call vote.

            WHEREAS, the Town Board of the Town of Mayfield was petitioned by Dimark Development  Northville, LLC, on or about March 18, 2008 for the annexation of certain lands in the Town of Mayfield being identified on the Fulton County Tax Map for the Town of Mayfield as section 104-1- 23; 104.9-1-3 and 104.9-1-2 consisting of 4.65 acres, and

            WHEREAS, the Town Board of the Town of Mayfield and the Village Board of the Village of  Mayfield conducted a joint meeting on May 15,2008 at Mayfield Town Hall, 28 North School Street, Mayfield, New York at which time all parties interested in the matter were heard and,

            WHEREAS, the Town Board of the Town of Mayfield has duly considered said Petition and the statements and evidence presented at said meeting,

            NOW, THEREFORE BE IT

            RESOLVED, that in accordance with Section 711 of the General Municipal Law, the Town Board of the Town of Mayfield hereby determines and finds as follows:

•1.                  That the Petition of Annexation substantially complies with the requirements of Article 17 of the General Municipal Law.

•2.                  That the Petition is the sole owner of all the territory proposed to be annexed to the Village of Mayfield and the property is vacant.

•3.                  That the annexation of the aforesaid property will permit the Petitioner to receive Village water and sewer services for the property proposed development.

•4.                  That the property cannot be developed to its fullest potential without being able to receive Village water and sewer services.

•5.                  That the Village of Mayfield is fully able to meet the water and sewer demands of the property when it is fully developed.

•6.                  The Village Board of the Village of Mayfield has approved the proposed annexation and stands ready and willing to complete the annexation process.

•7.                  That by reason of the foregoing this annexation is in the overall public interest.

This writing shall constitute the resolution, Determination and Order of the Town Board and it is authorized that a copy of it be filed with the Clerks of the appropriate local governments, school district and fire district.

RES# 84 APPROVAL OF ANNEXATION FOR HAYNER PROPERTY

On motion by Councilman Putman and seconded by Councilman Argotsinger the following resolution was ADOPTED 5AYES O NAY by roll call vote.

            WHEREAS, the Town Board of the Town of Mayfield was petitioned by Brian Hayner and Laura Hayner on or about March 18, 2008 for the annexation of certain lands in the Town of Mayfield being identified on the Fulton County Tax Map for the Town of Mayfield as Section 104, Block 1, Lot 1 consisting of 51.6 acres, and

            WHEREAS, the Town Board of the Town of Mayfield and the Village Board of the Village of Mayfield conducted a joint meeting on May 15, 2008 at Mayfield Town Hall , 28 North School Street, Mayfield, New York, at which time all parties interested in the matter were heard and,

            WHEREAS, the Town Board of the Town of Mayfield has duly considered said Petition and the statements and evidence presented at said meeting,

            NOW, THEREFORE, BE IT

Mike Stewart CEO highlighted the proposed local law 1 of 2008 Outside Wood Boiler Law.

 

RES# 84 SET PUBLIC HEARING FOR PROPOSED LOCAL LAW #1 OF 2008

On motion by Councilman Argotsinger seconded by Councilman Ruliffson the following resolution was ADOPTED 4 AYES (McLain, Argotsinger, Humphrey, Ruliffson) 1 ABSTAIN (Putman)

RESOLVED that the Mayfield Town Board approves to set a public hearing for July 17, 2008 at 7:15 PM for proposed local law 1 of 2008 Outdoor Wood Boiler Law.

Mike Stewart CEO explained the suggested zoning changes. A discussion followed.

 

BUILDING INSPECTOR REPORT- Mike Stewart CEO submitted his monthly report which included 17 permits issued for the month.

 

ASSESSOR REPORT- Kathi Hillock Assessor submitted her monthly report which included that the county has added a cold war exemption and raising the income for the senior exemption.

 

HIGHWAY SUPERINTENDENT REPORT- Mel Dopp Highway Superintendent submitted his monthly report which included that the new truck has arrived, ditching on Jackson Summit to begin shortly, culvert on Beech Street needs to be replaced, paving to begin mid July, tree down on Kettle Road early Tuesday morning,

A discussion was held on School Street Bridge that needs to be repaired.

Councilman Putman questioned when Sand Hill was going to be paved? Also suggested taking out the third bump.

A discussion was held on the easement with Huckan's on Lakeview Road., Supervisor McLain will contact Attorney on this.

 

SUPERVISOR'S REPORT- Supervisor McLain reported that the sale of Dominick's should be coming next week.

 

COMMITTEE REPORTS

BEACH- A work party will be held on Saturday, June 21st at 9AM.

 

RES# 85 CHANGE DATE OF OPENING OF TOWN BEACH

On motion by Councilman Ruliffson and seconded by Councilman Humphrey the following resolution was ADOPTED 5 AYES (McLain, Argotsinger, Humphrey, Putman, Ruliffson) 0 NAY

RESOLVED that the Mayfield Town Board approved to change the opening date of the Mayfield town beach from June 21 to June 28, 2008.

 

RES# 86 APPROVAL OF BEACH EMPLOYEES

On motion by Councilman Ruliffson and seconded by Councilman Argotsinger the following resolution was ADOPTED 5 AYES (McLain, Argotsinger, Humphrey, Putman, Ruliffson) 0 NAY

RESOLVED that the Mayfield Town Board approves to hire the following beach employees for 2008

Carl Edwards at $10.  Per hour

Sara Brand head lifeguard at $11.02 per hour

Desiree Wilcox lifeguard at $10. Per hour

Kathleen Dugan lifeguard at $10. Per hour

 

The Town Clerk's report was submitted with fees collected in the A account $473.05 B account $2655.75 Decals $2.94

 

RES # 87 APPROVAL OF VOUCHERS

On motion by Councilman Argotsinger and seconded by Councilman Humphrey the following resolution was ADOPTED 4 AYES (McLain, Argotsinger, Humphrey, Ruliffson) 1 NAY (Putman)

RESOLVED that the Mayfield Town Board approves the payment of vouchers in the following accounts

General Townwide   vouchers 178-210                        $18,689.89

General Outside        vouchers 20-24                         $1,113.25

Highway Outside DB vouchers 74-92              $39,194.15

 

Dorothy Hart updated the board on the new voting machines to start being used this fall and asked everyone to have a lot of patience with the election inspectors who are learning to run these machines.

 

PUBLIC- Betty Tabor Historian reported that the glove display will be taken down at the end of the month.  Also the Wilkinson Glove Company sign has been placed at the Rice Homestead.

 

RES# 88 CLOSE PUBLIC HEARING ON UNSAFE BUILDING

On motion by Councilman Humphrey seconded by Councilman Argotsinger the following resolution was ADOPTED 5 AYES (McLain, Argotsinger, Humphrey, Putman, Ruliffson) 0 NAYS

RESOLVED that the Mayfield Town Board authorizes to close the public hearing at 9:00 PM for SBL#45.3-1-30 at 885 Co Hwy 123 to declare this building unsafe.

 

Aarron Howland thanked the board and Mike Stewart CEO for doing the outdoor wood boiler law in a short period of time.

 

On motion by Councilman Humphrey seconded by Supervisor McLain the meeting was adjourned at 9:10 PM 5 AYES (McLain, Argotsinger, Humphrey, Putman, Ruliffson) 0 NAY
