The Town of Mayfield Town Board met Thursday, May 15, 2008 at the Mayfield Municipal Complex 28 North School Street, Mayfield, NY. The meeting was called to order at 7:00 PM and opened with the Pledge of Allegiance led by Supervisor Alan McLain.

 

Supervisor McLain gave an update on Bushnell Road and stated it should be completed in a couple of weeks, the Huckans Easement on Lakeview Road has been signed, and the Post Office lease has been signed by both parties and filed in the county clerk's office and work should begin soon.

The Town Board meeting was adjourned at 7:05PM

 

RES# 65 OPEN JOINT TOWN/ VILLAGE MEETING

On motion by Councilman Ruliffson, seconded by Councilman Humphrey the resolution was ADOPTED 9 AYES (McLain, Argotsinger, Humphrey, Putman, Ruliffson, H. Hart, T.Hart, Wilde, Garrigan)

 

BE IT RESOLVED that the Mayfield Town/Village Boards open a joint meeting at 7:05 PM for the purpose of annexation of two parcels of property owned by DiMark Development and the Hayner family on St Hwy 30.

 

RES# 66 APPOINT SUPERVISOR  MCLAIN AS CHAIRMAN OF THE MEETING

On motion by Councilman Putman, seconded by Councilman Argotsinger the following resolution was ADOPTED 9 AYES (McLain, Argotsinger, Humphrey, Putman, Ruliffson, H. Hart, T. Hart, Wilde, Garrigan)

 

Attorney Greco read the public hearing notice.

 

Mark Murphy owner of DiMark Development gave a brief history on how he got started in Mayfield and why he would like to build a hotel here.

Attorney Paul Kolodziej gave a presentation on the annexation process.

Ralph Acquaro stated the school had sent a letter against the annexation, due to the concern over the capital need for water and sewer.

 Barrie Hampton asked if a cost analyst would be given before the boards vote on the project.

Bob Carroll stated he felt they should pay for their own sewer hookups like everyone else.

Attorney Greco reported that part of the project is already in the Village.

Mayor Hart reported that the main line for the sewer and water is very near the proposed hotel already and the present sewer system can handle the hotel without expanding.

Attorney Kolodziej reported there will be many more meetings regarding the project and this is just for annexation purposes only.

 

RES# 67 CLOSE JOINT MEETING

On motion by Mayor Hart, seconded by Trustee Garrigan the following resolution was ADOPTED (McLain, Argotsinger, Humphrey, Putman, Ruliffson, H Hart, T. Hart, Garrigan, Wilde)

 

RESOLVED that the Mayfield Town Board and the Mayfield Village Board approve to close the joint meeting at 7:25 PM

 

The Town Board continued with their meeting.

 

Dominick Locorriere requested a waiver from the town board on his liquor license renewal. He presented a petition with 140 signatures in favor of him getting the waiver.

 

Don Voorhees, a neighbor, stated that last year they had about 12 issues with him and as of today only one of the issues have been settled. He stated there are on going problems and  showed pictures of garbage all over near his dumpsters, with the lids up on dumpsters so the roaches can get into the garbage.

 

Andy Luey stated when he purchased his property he was interested in the boat slips and has not had any problems with Dominick's.

 

Doug Souchy stated he has lived there for a long time and feels the problems should be taken care of by the state police and town constables.

 

Pat Williams stated she felt the biggest problem to be the bands performing till 3 or 4 in the morning.

 

Kathy Voorhes stated she has a concern over the very loud music that is played outside on the weekends. It is so loud she can't sit outside at her picnic table and have a conversation with anyone at the same table.

 

Supervisor McLain asked for a motion to grant a waiver.  No one made a motion to grant the waiver, and the meeting went to the next item on the agenda.

 

Code Enforcement Report was submitted with 8 permits issued for the month with $670.00 collected.

 

RES# 68 SET PUBLIC HEARING ON TWO UNSAFE BUILDINGS

On motion by Councilman Putman, seconded by Councilman Argotsinger the following resolution was ADOPTED 5 AYE (McLain, Argotsinger, Humphrey, Putman, Ruliffson)

 

RESOLVED that the Mayfield Town Board approves to set a public hearing for June 19, 2008 at 7:15 PM for properties at 887 Co Hwy 123, SBL # 45.3-1-31 and property at 885 Co Hwy 123, SBL # 45.3-1-30 to declare these two buildings unsafe.

 

RES# 69 AUTHORIZE SUPERVISOR TO SIGN PICTOMETRY PROGRAM

On motion by Councilman Argotsinger, seconded by Councilman Humphrey the following resolution was ADOPTED 5 AYE (McLain, Argotsinger, Humphrey, Putman, Ruliffson)

 

RESOLVED that the Mayfield Town Board authorizes Supervisor McLain to sign the contract for pietrometry program for the CEO, which will cost $100.00 per year and be charged to the CEO's budget.

 

ASSESSOR report was submitted with grievance day being May 27th.

Councilman Putman questioned what the taxable value is for the Village.

 

RES# 69 EXTENDING THE TERMS OF OFFICE FOR CLERK, SUPERVISOR AND HIGHWAY SUPERINTENDENT

On motion by Councilman Ruliffson, seconded by Councilman Humphrey the following resolution was ADOPTED 4 AYE (McLain, Argotsinger, Humphrey, Ruliffson) 1 NAY (Putman)

 

WHEREAS the offices of Town Supervisor, Town Clerk and Town Superintendent of Highways in the Town of Mayfield are elective offices, and

WHEREAS the present term of each such office is for a period of two (2) years, and

WHEREAS the Town Board of the Town of Mayfield is desirous of extending the term of each office to a period of four (4) years, in accordance with the statute,

NOW, THEREFORE, BE IT HEREBY RESOLVED by the Town Board of the Town of Mayfield, in plenary session duly convened, that the term of the elective offices of Town Supervisor, Town Clerk and Town Superintendent of Highways in the Town of Mayfield shall hereafter be for a period of four (4) years, and

BE IT FURTHER RESOLVED that this Resolution shall be submitted to the qualified electors of the Town of Mayfield for their approval or disapproval at the next biennial Town election, and

BE IT FURTHER RESOLVED that this Resolution shall not become effective until approved by the affirmative vote of the majority of the qualified electors of the Town voting on such proposition.

 

HIGHWAY SUPERINTENDENT REPORT  Mel Dopp submitted his monthly report which included roads that were closed due to flooding, sent an employee to flagging school,  preparing Bushnell Road for paving, 4 bids were sent out for tree removal, and 2 were received but neither bidder have workmen's compensation, Supervisor McLain and Mr. Dopp met with a NYS engineer on School Street bridge and they decided to post the bridge at 20 to 25 ton soon.

 

Councilman Putman reported on behalf of the highway committee that 5 bids had been received for the paving of three roads in the town ranging from 54.55 to 61.40 per ton. The Highway Committee recommended that the paving be awarded to Empire Paving, the low bidder.

 

RES# 70 AWARD PAVING BID

On motion by Councilman Argotsinger seconded by Councilman Humphrey the following resolution was ADOPTED 5 AYE (McLain, Argotsinger, Humphrey, Putman, Ruliffson)

RESOLVED that the Mayfield Town Board approves to award the paving bid to Empire Paving,1982 Duanesburg Road, Duanesburg, NY at $54.55 per ton.

 

SUPERVISOR'S REPORT-

Supervisor McLain reported on the meeting for the Rte29 &30 roundabouts. Three Councilmen attended along with the Highway Superintendent, concern was that Co Hwy 106 was not included but sidewalks are going to erected and the town will need to take care of them.

 

RES# 71 AUTHORIZE SUPERVISOR TO SENT LETTER

On motion by Councilman Argotsinger seconded by Councilman Putman to authorize Supervisor McLain to send a letter to NYS D.O.T. strongly opposing building sidewalks on this project, and urging them to use money designated for sidewalks towards resolving problems at the intersection of Co Hwy 106 and State Route 30.

On motion by Councilman Argotsinger, seconded by Councilman Humphrey the following resolution was ADOPTED 5 AYE (McLain, Argotsinger, Humphrey, Putman, Ruliffson)

 

Supervisor McLain reported that 2 letters had been received concerning outdoor wood boilers in addition to Mr. Hime's complaint at last month's meeting.

Aarron Howland 459 Warren Road stated he shuts down his outdoor furnace in the summer.

Elizabeth Howland stated she can't open windows or hang clothes out as neighbor has an outdoor furnace and the smoke comes right her way.

Kevin Bornt stated he had a contractor come to do some work on his roof and the smoke was so bad they couldn't read the tape measure.

Aarron Howland questioned what kind of regulations the town would pass.

Will Michaels reported that he has centralized air in his house because of his neighbor's wood boiler, and has tried to get along with his neighbor.

Pete & Mickey Nelli stated that would like a little consideration in the summer.

Supervisor McLain stated CEO Stewart has researched similar laws in effect for OWB's and has given the board a list to consider for a new law for OWB's.

 

RES# 72 APPROVE EASEMENT REQUEST FOR JON CLOSE

On motion by Councilman Ruliffson seconded by Councilman Putman the following resolution was ADOPTED 5 AYES (McLain, Argotsinger, Humphrey, Putman, Ruliffson)

RESOLVED that the Mayfield Town Board approves an easement for Jon Close on Lakeview Road, to replace a water line that is presently there in front of his barn, contingent upon filing of all legal paperwork necessary.

 

Supervisor McLain reported there are two requests for changes in zoning on two properties near Rte. 30 and Bellen Road.  He will forward the requests to the Planning Board.

Supervisor McLain reported on the new Gloversville Transit routes in our town that started on Monday May 13th.

 

BEACH COMMITTEE

RES# 73 APPROVE OPENING, CLOSING DATES FOR BEACH & PERMIT USE

On motion by Councilman Argotsinger seconded by Councilman Putman the following resolution was ADOPTED 5 AYE (McLain, Argotsinger, Humphrey, Putman, Ruliffson)

RESOLVED that the Mayfield Town Board approves to set opening day for the town beach as June 21st, closing date of August 21st,  and the beach will operate on seasonal permits only for Mayfield town residents and Mayfield school district residents.

 

RES# 74 APPOINTMENT OF DAVE BARTON & CLIFFORD MARCELLUS

On motion by Councilman Humphrey seconded by Councilman Ruliffson the following resolution was ADOPTED 5 AYES (McLain, Argotsinger, Humphrey, Putman, Ruliffson)

 

RESOLVED that the Mayfield Town Board approves the appointments of David Barton and Clifford Marcellus as part time laborers for the refuse department at $14.91 per hour.

 

RES# 75 APPOINTMENT OF DEPUTY HIGHWAY SUPERINTENDENT

On motion by Councilman Ruliffson seconded by Councilman Argotsinger the following resolution was ADOPTED 5 AYE (McLain, Argotsinger, Humphrey, Putman, Ruliffson)

 

RESOLVED that the Mayfield Town Board approves the appointment of James Blowers as deputy highway superintendent effective March 3, 2008.

 

The Town Clerk's report was submitted with fees collected in the A account $581.67, and  B account $810.28

 

RES# 76 APPROVE PAYMENT OF VOUCHERS

On motion by Councilman Argotsinger seconded by Councilman Putman the following resolution was ADOPTED 5 AYES (McLain, Argotsinger, Humphrey, Putman, Ruliffson)

 

RESOLVED that the Mayfield Town Board approves the payment of vouchers in the following accounts

General Townwide  vouchers 142-177          $16,019.34

General Outside       vouchers19                       $442.38

Highway Townwide voucher30             $61.90

Highway Outside      vouchers 56-73                $12,327.15

 

Supervisor McLain requested the highway committee draft a garbage policy for the town and report back at next month's meeting.

 

Councilman Putman questioned if the garbage problem in the trailer park is in cage or on the lot.

 

PUBLIC/ OTHER

Mel Dopp Highway Superintendent questioned how many quotes he needed for engineering services for bridge repair.

Sandy Marshall inquired about a possible zoning change on Sand hill Road.

 

RES# 77 MOVE INTO EXECUTIVE SESSION

On motion by Councilman Argotsinger seconded by Councilman Ruliffson the following resolution was ADOPTED 5 AYES (McLain, Argotsinger, Humphrey, Putman, Ruliffson)

RESOLVED that the Mayfield Town Board approves to move into executive session at 9:05 PM for the purpose of reviewing applicants for Planning Board vacancy.

 

RES# 78 MOVE INTO REGULAR SESSION

On motion by Councilman Ruliffson seconded by Councilman Putman the following resolution was ADOPTED 5 AYE (McLain, Argotsinger, Humphrey, Putman, Ruliffson)

RESOLVED that the Mayfield Town Board approves to move out of executive session and back into regular session at 9:08 PM.

 

RES# 79 APOINTMENT OF ROBERT PHILLIPS

On motion by Councilman Ruliffson seconded by Councilman Humphrey the following resolution was ADOPTED (McLain, Argotsinger, Humphrey, Putman, Ruliffson)

RESOLVED that the Mayfield Town Board approves the appointment of Robert Phillips to the unexpired term of Nancy Deitch on the Planning Board thru December 31, 2008.
