A regular meeting of the Mayfield Town Board was held on Thursday, November 15, 2007 at the Mayfield Municipal Complex 28 N School Street. The meeting was called to order at 7:00 PM and opened with the Pledge of Allegiance led by Supervisor McLain.

PUBLIC- No one spoke at this time.

 

RES# 136 ADOPTION OF 2008 TOWN BUDGET

On motion by Councilman Ryan and seconded by Councilwoman Sieg the following resolution was ADOPTED 4 AYES (McLain, Argotsinger, Ryan, Sieg) 1 NAY (Putman)

RESOLVED that the Mayfield Town Board adopts the 2008 preliminary budget as the budget for 2008.

 

RES# 137 ACCEPTANCE OF DEDICATED DEED TO DONJE LANE

On motion by Councilman Argotsinger and seconded by Councilman Putman the following resolution was ADOPTED 5 AYES (McLain, Argotsinger, Putman, Ryan, Sieg) 0 NAY

            WHEREAS, a certain parcel of land known as "Donje Lane" has been offered for dedication to the Town of Mayfield for highway purposes, which said parcel of land is presently owned by Donald Russell, and is shown upon a survey map prepared by Charles R. Ackerbauer, P.E.L.S. entitled "Survey Map of land of Donald Russell to be conveyed to Town of Mayfield" which bears date of September 2007, and

            WHEREAS, the Highway Superintendent of the Town of Mayfield has recommended acceptance of said parcel for dedication purposes, and has found the said parcel to meet all specifications set forth by the Town of Mayfield for a proposed town road, and

            WHEREAS, the Town Attorney for the Town of Mayfield has reviewed all of the requisite legal documents for the Town's acceptance of the said parcel to be dedicated as a town road, and has recommended that the Town of Mayfield accept the parcel for dedication as a town road to be known as "Donje Lane",

            NOW, THERFORE, be it resolved by the Town Board of the Town of Mayfield, in regular session duly convened, that the Town Board of the Town of Mayfield hereby agrees to accept the deed of dedication for the said road to be known as "Donje Lane" and hereby directs the Town Attorney to record the said deed in the Fulton County Clerk's Office, and it is

            FURTHER RESOLVED, that the recorded deed and the Abstract of Title for the said dedicated road are to be kept by  the Town Clerk as permanent records of the Town of Mayfield.

 

Supervisor McLain reported that he had received a letter from Attorney Zee requesting a 50 foot wide utility easement over Lakeview Road for Paradise Point Development Corporation, which is owned by Dave Huckans.

 

RES# 138 DIRECT SUPERVISOR TO CONTACT ATTORNEY

On motion by Councilman Ryan and seconded by Councilman Putman the following resolution was ADOPTED 5 AYES (McLain, Argotsinger, Putman, Ryan, Sieg) 0 NAY

RESOLVED that the Mayfield Town Board approves to direct Supervisor McLain to authorize the town attorney to start the process for a 50 foot utility easement over Lakeview Road for Paradise Point Development Corporation, which is owned by David Huckans.

 

Supervisor McLain reported that he had received a request from the Southern Adirondack Snowmobile Club to maintain trails in the Town of Mayfield. The club also provided the town with a certificate of insurance.

 

RES# 139 GRANT PERMISSION TO SOUTHERN ADIRONDACK SNOWMOBILE CLUB

On motion by Councilman Putman and seconded by Councilman Argotsinger the following resolution was ADOPTED 5 AYES (McLain, Argotsinger, Putman, Ryan, Sieg) 0 NAY

RESOLVED that the Mayfield Town Board authorizes permission to the Southern Adirondack Snowmobile Club for trail maintenance in the Town of Mayfield.

 

The proposed Right to Farm Law was presented to the Town Board and it was decided to hold a public hearing at the December 6th meeting.

 

RES# 140 APPROVE TO SET PUBLIC HEARING ON RIGHT TO FARM LAW

On motion by Councilwoman Sieg and seconded by Councilman Argotsinger the following resolution was ADOPTED 5 AYES (McLain, Argotsinger, Putman, Ryan, Sieg) 0 NAY

RESOLVED that the Mayfield Town Board approves to set a public hearing on December 6th at 7:15PM for the proposed right to farm law.

 

HIGHWAY SUPERINTENDENT REPORT- Tom Ruliffson Highway Superintendent reported that the Bushnell Road Bridge is coming along nicely and are waiting for the decking. All equipment is ready for winter. Has 45 days left before retirement. Some trees need to be taken down and he will start the process next week.

 

BUILDING INSPECTOR REPORT- Mike Stewart CEO submitted his monthly report which included 21 permits issued. The carwash at the Mobil Mart has opened. Also questioned next step on zoning changes.

A small discussion followed on the zoning changes.  

 

RES# 141 OPEN PUBLIC HEARING ON BROADALBIN FIRE DEPARTMENT BUDGET

On motion by Councilman Putman and seconded by Councilwoman Sieg the following resolution was ADOPTED 5 AYES (McLain, Argotsinger, Putman, Ryan, Sieg) 0 NAY

RESOLVED that the Mayfield Town Board approves to open the scheduled public hearing on the Fire Protection Contract with Broadalbin Kennyetto Fire Department at 7:15PM.

 

Mike Stewart CEO read the certificate of publication.

Supervisor McLain read a letter he had received from the department regarding a request from them to pass a town law to allow them to enter into a revenue recovery service agreement. He will request the department attend our next meeting to explain and have the town attorney there also.

 The public hearing was left open and the town continued with town business.

 

ASSESSOR REPORT- Kathi Hillock Assessor submitted her monthly report and stated she has been very busy with senior exemptions and star rebates.

 

SUPERVISOR REPORT- Supervisor McLain reported that he had contacted Precision Environmental and requested that they notify DEC of there finding on the contaminated soil in hopes they would allow us to spread the soil somewhere other than at Mud Road.

The surplus money from the grant at the beach has been extended to July 30, 2008.

A contractor and an architect will be meeting next week at the post office.

Association of Town training for new officials will be January 7-9.

Clean Up days have been set for 2008

Attorney Greco will contact Attorney Zamellis to get zoning document on a disk.

A small discussion was held on advertising for openings on the assessment review board, Planning Board and Zoning Board of Appeals.

Cheryl Gifford's father passed away this week and a card and donation was sent.

 

RES# 142 CLOSE PUBLIC HEARING ON FIRE PROTECTION CONTRACT

On motion by Councilwoman Sieg and seconded by Councilman Putman the following resolution was ADOPTED 5 AYES (McLain, Argotsinger, Putman, Ryan, Sieg) 0 NAY

RESOLVED that the Mayfield Town Board approves to close the public hearing at 7:30PM on the fire protection contract.

 

RES# 143 AUTHORIZE SUPERVISOR TO SIGN CONTRACT

On motion by Councilman Putman and seconded by Councilman Argotsinger the following resolution was ADOPTED 5AYES (McLain, Argotsinger, Putman, Ryan, Sieg) 0 NAY

RESOLVED that the Mayfield Town Board approves to accept the fire protection contract with the Broadalbin Kennyetto Fire Department in the sum of $33,681.80 effective January 1, 2008 - December 31, 2008.

 

FINANCIAL

The Town Clerk report was submitted with fees collected in the A account $90.01 B account $1260.00 Decals $38.59

 

RES# 144 APPROVAL OF VOUCHERS

On motion by Councilman Ryan and seconded by Councilwoman Sieg the following resolution was ADOPTED 5 AYES (McLain, Argotsinger, Putman, Ryan, Sieg) 0 NAY

RESOLVED that the Mayfield Town Board approve the payment of vouchers in the following accounts

General Townwide A   vouchers 298-324                     $17,208.55

General Outside B          vouchers 80-81                      $542.04

Highway Townwide DA voucher 16                             $4,473.69

Highway Outside DB vouchers 168-190                       $83,432.37

 

PUBLIC / OTHER

Supervisor McLain reported that the Holiday Gathering would be held on Thursday December 20th from 4-7 PM. Cheryl Gifford will cater the event and requested that the three retiring officials be available at 6PM for a presentation.

 

Councilman Ryan asked if any of the fire department members who were in attendance could explain to the town board what the recover policy agreement form was. They stated they could not have such an agreement because they are a fire district.

 

Councilman Ryan thanked the fire district for the new furnace.

Councilman Argotsinger thanked Supervisor McLain for his no vote on the salary increase for John Stead at the county meeting.

 

The next meeting will be December 6, 2007 at 7:00 PM
