Body:

A regular meeting of the Mayfield Town Board was held on Thursday, October 19, 2006 at the Mayfield Municipal Complex 28 North School Street in the Village of Mayfield. The meeting was called to order at 7:00 PM by Supervisor Alan McLain.

The Pledge of Allegiance was led by Supervisor McLain.

PUBLIC- No one spoke at this time.


DEPARTMENT REPORTS

BUILDING INSPECTOR REPORT- Mike Stewart CEO reported that he had issued 25 permits for the month and two variances were issued. Also Mike Bill’s permanent junkyard application has been completed.


RES# 160 APPROVAL OF PERMANENT JUNKYARD PERMIT

On motion by Councilman Putman and seconded by Councilman Ryan the following resolution was ADOPTED 5 AYES (McLain, Ryan, Sieg, Argotsinger, Putman) 0 NAYS


RESOLVED that the Mayfield Town Board approves the permanent junkyard application for Michael Bills 3045 St Hwy 30 SBL# 120.-3-19.1


Mike Stewart CEO explained that the final specs are in for the lift. A small discussion followed with the board’s recommendation that a completion date of 90 days from the date the bid is awarded was agreed.


RES# 161 BIDS FOR LIFT

On motion by Councilman Ryan and seconded by Councilwoman Sieg the following resolution was ADOPTED 5 AYES (McLain, Ryan, Sieg, Argotsinger, Putman) 0 NAYS


RESOLVED that the Mayfield Town Board approves to advertise for bids for the lift at the Municipal Complex with bids due back by November 30. Bids will be opened at 2PM on November 30th.


Mayor Greg Dietch explained why the village wanted a permanent easement rather than a temporary easement for Lakeside Drive.


SUPERVISOR REPORT- Supervisor McLain reported that the town had received a letter from the APA on the Bushnell Road Bridge. The town does not need approval from the APA.

POSTOFFICE UPDATE- Supervisor McLain reported that the revised contract should arrive early next week. He reported the postal service would like the heat left on at the old village hall. The town will be reimbursed by the postal service for those costs by the postal service.

GRANT APPLICATION- Supervisor McLain reported that the town has provided the Fire District #2 with their required documents.

COUNTY NEWS- Supervisor McLain reported that public health would like to make a presentation on the flu outbreak.


ATTORNEY REPORT- Attorney Greco explained the requested easement between the Village of Mayfield and the Town of Mayfield.

Councilman Ryan explained his concerns over a permanent easement rather than a temporary easement.

The Board agreed to the permanent easement with a letter from the state counsel of the Board of Health  to the town attorney.


RES#162 AUTHORIZE SUPERVISOR TO SIGN EASEMENT PENDING LEGAL APPROVAL

On motion by Councilman Putman and seconded by Councilwoman Sieg the following resolution was ADOPTED 5 AYES (McLain, Ryan, Sieg, Argotsinger, Putman) 0 NAYS


RESOLVED that the Mayfield Town Board authorizes Supervisor McLain to sign the permanent easement for the Village of Mayfield on Lakeside Drive pending approval from town legal counsel.


RES# 163 OPEN PUBLIC HEARING ON PROPOSED LOCAL LAW #1 2006 AMENDING JUNKYARD LAW

On motion by Councilman Ryan and seconded by councilwoman Sieg the following resolution was ADOPTED 5 AYES (McLain, Ryan, Sieg, Argotsinger, Putman) 0 NAYS


RESOLVED that the Mayfield Town Board approves to open the scheduled public hearing at 7:40 PM.

The Town Clerk read the certificate of publication.


RES# 164 OPEN PUBLIC HEARING ON PRELIMINARY BUDGET

On motion by Councilman Ryan and seconded by Councilman Putman the following resolution was ADOPTED 5 AYES (McLain, Ryan, Sieg, Argotsinger, Putman) 0 NAYS


RESOLVED that the Mayfield Town Board approves to open the scheduled public hearing on the preliminary budget at 7:30PM.

The Town Clerk read the certificate of publication.


The public hearings were left open and the town continued with town business.


Attorney Greco explained the paving agreement with the Fire District.


RES# 165 AUTHORIZE SUPERVISOR TO SIGN INTERMUNICIPAL AGREEMENT WITH FIRE DISTRICT

On motion by Councilwoman Sieg and seconded by Councilman Argotsinger the following resolution was ADOPTED 5 AYES (McLain, Ryan, Sieg, Argotsinger, Putman) 0 NAYS.


RESOLVED that the Mayfield Town Board authorizes the Supervisor to sign the intermunicipal agreement with the Fire District for paving of the parking lot located at 28 North School Street.


Jane Potts Dog Control Officer spoke about the local law that was recently passed in the Town of Perth regarding barking of dogs. Attorney Greco will review our local law to regarding the DCO’s concern as well as other parts of the law that might need revising.

Councilman Ryan questioned the time frame for the zoning changes that Attorney Zamelis is working on.


COMMITTEE REPORTS/ UPDATES

HIGHWAY COMMITTEE- Councilman Putman reported that School Street and Warren Road have been paved. Equipment has been moved to Mariners Road.

Surplus Equipment bids to be returned by 12 noon on October 31st with opening of bids at 2PM.

Councilman Argotsinger reported that Bob Ambrosino from Soil & Water will be visiting the property on North Main Street in question.


RES# 166 CLOSE PUBLIC HEARING ON JUNKYARD LAW

On motion by Councilman Ryan and seconded by Councilwoman Sieg the following resolution was ADOPTED 5 AYES (McLain, Ryan, Sieg, Argotsinger, Putman) 0 NAYS


RESOLVED that the Mayfield Town Board approves to close the public hearing on the amendment to the junkyard law at 8:05PM.


RES#167 ADOPT LOCAL LAW #1 OF 2006

On motion by Councilwoman Sieg and seconded by Councilman Ryan the following resolution was ADOPTED 5 AYES (McLain, Ryan, Sieg, Argotsinger, Putman) 0 NAYS


RESOLVED that the Mayfield Town Board approves to adopt local law #1 of 2006 to amend the Town of Mayfield Junk Yard, Junk Motor vehicle and Junk Mobile Home Law in regards to the definition of “Junkyard”.


RES# 168 CLOSE OF PUBLIC HEARING ON BUDGET

On motion by Councilman Putman and seconded by Councilman Argotsinger the following resolution was ADOPTED 5 AYES (McLain, Ryan, Sieg, Argotsinger, Putman) 0 NAYS


RESOLVED that the Mayfield town Board approves to close the public hearing on the preliminary budget at 8:05PM.


Supervisor McLain gave an update on the two highway employees that were involved in an automobile accident on October 6th.  One of the employees didn’t lose any time from work the other employee will be out for an extended time.


The Town Clerk’s report was submitted with fees collected in the A account $249.89 Decals $62.13 B account $2287.39



RES# 169 APPROVAL OF VOUCHERS

On motion by Councilwoman Sieg and seconded by Councilman Putman the following resolution was ADOPTED 5 AYES (McLain, Ryan, Sieg, Argotsinger, Putman) 0 NAYS


RESOLVED that the Mayfield Town Board approves the payment of vouchers in the following accounts

General Townwide                   vouchers 268-295                    $25,410.15

General Outside                        vouchers 69-71                        $5,529.58

Highway  Outside                     vouchers153-166                     $41,139.22


RES#170 RESCIND RESOLUTION 139

On motion by Councilwoman Sieg and seconded by Councilman Putman the following resolution was ADOPTED 5 AYES (McLain, Ryan, Sieg, Argotsinger, Putman) 0 NAYS


RESOLVED that the Mayfield Town Board approves to rescind resolution #139 of September 7, 2006 regarding budget transfers.


RES# 171 BUDGET TRANSFER

On motion by Councilwoman Sieg and seconded by Councilman Argotsinger the following resolution was ADOPTED 5 AYES (McLain, Ryan Sieg, Argotsinger, Putman) 0 NAYS


RESOLVED that the Mayfield Town Board approves the following budget transfer.

Transfer $700 from B8020.41 to

$350 to 8010.10 zoning Board clerk

$350 to 8020.11 planning board clerk


RES # 172 APPROVAL OF MINUTES

On motion by Councilman Ryan and seconded by Councilman Putman the following resolution was ADOPTED 5 AYES (McLain, Ryan, Sieg, Argotsinger, Putman) 0 NAYS


RESOLVED that the Mayfield Town Board approves the minutes of September 21, 2006 as submitted.


RES# 173 MOVE INTO EXECUTIVE SESSION

On motion by Councilman Ryan and seconded by Councilman Putman the following resolution was ADOPTED 5 AYES (McLain, Ryan, Sieg, Argotsinger, Putman) 0 NAYS


RESOLVED that the Mayfield Town Board approves to move into executive session for the purpose of personnel at 8:10PM.


RES# 174 MOVE OUT OF EXECUTIVE SESSION

On motion by Councilwoman Sieg and seconded by Councilman Putman the following resolution was ADOPTED 5 AYES (McLain, Ryan, Sieg, Argotsinger, Putman) 0 NAYS


RESOLVED that the Mayfield Town Board approves to move out of executive session and back into regular session at 8:33 PM.


A lengthy discussion was held on the budget.

Councilman Putman voiced his concern over the village residents not paying their fair share.


RES# 175 PERMISSION GRANTED TO TOWN CLERK TO ATTEND WORKSHOP

On motion by Councilman Argotsinger and seconded by Councilwoman Sieg the following resolution was ADOPTED 5 AYES (McLain, Ryan, Sieg, Argotsinger, Putman) 0 NAYS


RESOLVED that the Mayfield Town Board approves Dorothy Hart Town Clerk to attend a tax collection workshop on October 25th at the Fulton County Building.


On motion by Councilman Ryan and seconded by Councilwoman Sieg the meeting was adjourned at 9:15PM 5 AYES (McLain, Ryan, Sieg, Argotsinger, Putman) 0 NAYS
