Body:

A regular meeting of the Mayfield Town Board was held on Thursday, September 07, 2006 at the Mayfield Municipal Complex 28 North School Street, Village of Mayfield.

The meeting was called to order at 7:00PM by Supervisor Alan McLain.

The Pledge of Allegiance was led by Supervisor McLain.

A moment of silence was held for fallen fighter Myron Messak.

PUBLIC- Betty Tabor reminded everyone of the community picnic at the Rice Homestead on Sunday September 10th starting at 12noon.


A presentation on the town’s insurance was made by Bill Van Gorder of the Mang Insurance.


SUPERVISOR’S REPORT

Fire District #2 paving request-

RES# 129 INTERMUNICIPAL AGREEMENT WITH FIRE DISTRICT

On motion by Councilwoman Sieg and seconded by Councilman Argotsinger the following resolution was ADOPTED 4 AYES (McLain, Sieg, Argotsinger, Putman) 1 ABSENT (Ryan) 0 NAYS


RESOLVED that the Mayfield Town Board approves the Supervisor to sign an intermunicipal agreement with fire district # 2 for paving of the parking lot at the Municipal Complex upon approval by the Town Attorney.


Supervisor McLain reported that town attorney Greco is still working on the zoning law and junkyard law changes.


RES# 130 AUTHORIZE SUPERVISOR TO SIGN GROUND LEASE

On motion by Councilman Putman and seconded by Councilwoman Sieg the following resolution was ADOPTED 3 AYES (McLain, Sieg, Putman) 1 NAY (Argotsinger) 1 ABSENT (Ryan)


RESOLVED that the Mayfield Town Board authorizes the supervisor to sign the ground lease with the United States Postal Service for property at 13 N School Street pending final approval from town attorney Greco.


PROGRESS HEIGHTS REQUEST- A discussion was held on the sign at the entrance to Progress Heights and their request for a contribution towards a new sign.


BUSHNELL ROAD BRIDGE- Supervisor McLain reminded the highway committee of the meeting on Monday, September 11 at 7:00 PM with the engineer and the Highway Superintendent. The open public meeting will be held in the executive session room.


RES# 131 RESOLUTION URGING THE HUDSON RIVER- BLACK RIVER REGULATING DISTRICT TO ENSURE A SUFFICIENT PUBLIC REVIEW AND COMMENT PERIOD FOR RULE MAKING

On motion by Councilwoman Sieg and seconded by Councilman Putman the following resolution was ADOPTED 4 AYES (McLain, Sieg, Argotsinger. Putman) 1 ABSENT (Ryan) 0 NAYS


WHEREAS, the Hudson River- Black River Regulating District 9HRBRRD) is currently conducting a process to review and revise operating rules for regulations of the great Sacandaga Lake; and


WHEREAS, as part of the process, the HRBRRD is conducting  public meetings and gathering public input and comments regarding said rule making; and


WHEREAS, the Board of Directors of the HRBRRD has established tentative deadlines for completion of said rule making; and


WHEREAS, the proposed rules and regulations are a complete revision and expansion of the current rules and regulations; and


WHEREAS, the proposed new rules and regulations are much more extensive and potentially very costly to permit holders; and


WHEREAS, these rules and regulations, as proposed, will dramatically change the way that the permit system affects the users of the permit areas; and


WHEREAS, due to the complexity and volume of the proposed rules and regulations, residents and constituency groups, including citizens, organizations and local  governments need more time  to study, evaluate, and have questions answered in order to be able to make informed comments and recommendations; and


WHEREAS, other public agencies that may have jurisdiction and interest should be given the opportunity to comment; now therefore be it


RESOLVED, That the Town of Mayfield Town Board hereby urges the HRBRRD to ensure that the public comment period related to said rule making not begin until adequate public information and explanation has been provided to everyone affected by the proposed new rules and regulations; and be it further


RESOLVED, That the Town of Mayfield Town Board also urges the Board of Directors of HRBRRD to include specific provisions within Section 3.3 of the proposed rules and regulations prior to adoption that require an open and  extensive public hearing process each and every time amendments to said Rules are proposed in the future; and be it further


RESOLVED, That certified copies of this Resolution  be forwarded to HRBRRD, Saratoga County Board of Supervisors, Fulton County Board of Supervisors,  Fulton County Chamber of Commerce, Governor Pataki, Senator Farley, Assemblywoman Sayward, Adirondack Park Agency, Assemblyman Butler and to each and every other person, institution or agency who will further the purpose of this Resolution.


UPDATES- Supervisor McLain reported that the town had been notified that the check for $25,000 for the grant that former supervisor Carol Hart and Councilwoman Kathy Sieg had worked on should be here in two weeks. Many thanks for all the work.


Councilwoman Sieg questioned the status of the width of VanDenburgh Point Road that has been in question.


COMMITTEE REPORTS

HIGHWAY- Councilman Argotsinger reported on the issue on North Main Street regarding the ditch. He has been in contact with Mr. Ambrosino from Soil & Water and Adirondack Park Agency who will be visiting the site at the end of the month to make a discussion on if the area is wetlands. At this time the board is awaiting hearing back from Attorney Greco and determination from APA.


Contaminated Soil At Town – Councilman Argotsinger reported that he had spoke with Steve and they will be testing the pile this week and then will forward the results to Jeff Bouchard for possibly trucking to the landfill.


Fritz Lane- Councilman Argotsinger reported he had visited the area. A discussion was held on the turn around at the end of the road.


RES# 132 ACCEPT FRITZ LANE AS TOWN ROAD

On motion by Councilman Putman and seconded by Councilman Argotsinger the following resolution was ADOPTED 4 AYES (McLain, Sieg, Argotsinger, Putman) 1 ABSENT (Ryan) 0 NAYS


RESOLVED that the Mayfield Town Board upon the recommendation of the Highway Committee approves to accept Fritz Lane as a town road contingent on the owner (William Murphy) filing the necessary paperwork turning the road over to the town.


SURPLUS EQUIPEMENT- Councilman Putman reported on the surplus equipment that will be going out to bid.


RES# 133 BID OUT ON SURPLUS EQUIPMENT

On motion by Councilwoman Sieg and seconded by Councilman Argotsinger the following resolution was ADOPTED 4 AYES (McLain, Sieg, Argotsinger, Putman) 1 ABSENT (Ryan) 0 NAYS


RESOLVED that the Mayfield Town Board approves to bid out the surplus equipment on the recommendation of the highway committee.


RIGHT TO FARM LAW- Councilman Putman reported that he had spoken with Cooperative Extension and they were willing to serve on the committee.


BEACH is closed for the year.

RESOLVED that the Mayfield Town Board approves the minutes of August 17, 2006 as submitted.


RES# 135 MOVE INTO EXECUTIVE SESSION

On motion by Councilwoman Sieg and seconded by Councilman Putman the following resolution was ADOPTED 4 AYES (McLain, Sieg, Argotsinger, Putman) 1 ABSENT (Ryan) 0 NAYS


RESOLVED that the Mayfield Town Board approves to move into executive session at 8:25 PM for the purpose of personnel.


RES# 136 MOVE OUT OF EXECUTIVE SESSION

On motion by Councilwoman Sieg and seconded by Councilman Putman the following resolution was ADOPTED 4 AYES (McLain, Sieg, Argotsinger, Putman) 1 ABSENT (Ryan) 0 NAYS


RESOLVED that the Mayfield Town Board approves to move out of executive session and back into regular session at 9:00 PM.


RES# 137 NOT TO PAY BEACH EMPLOYEES WHEN BEACH CLOSES DUE TO FLOODING

On motion by Councilwoman Sieg and seconded by Councilman Putman the following resolution was ADOPTED 4 AYES (McLain, Sieg, Argotsinger, Putman) 0 NAYS 1 ABSENT (Ryan)


RESOLVED that the Mayfield Town Board approves not to pay the beach employees for days they didn’t work due to rain and or flooding.


RES# 138 APPOINTMENT OF PLANNING BOARD AND ZONING BOARD OF APPEALS CLERK

On motion by Councilwoman Sieg and seconded by Councilman Argotsinger the following resolution was ADOPTED 4 AYES (McLain, Sieg, Argotsinger, Putman) 0 NAYS 1 ABSENT (Ryan)


RESOLVED that the Mayfield Town Board approves to appoint Donna Hillriegel as Planning Board Clerk and Zoning Board of Appeals Clerk at $9.00 per hour not to exceed 15 hours per month for both boards.


RES# 139 APPROVE BUDGET TRANSFERS

On motion by Councilwoman Sieg and seconded by Councilman Putman the following resolution was ADOPTED 4 AYES ( McLain, Sieg, Argotsinger, Putman) 0 NAYS 1 ABSENT (Ryan)


RESOLVED that the Mayfield Town Board approves the following budget transfers

$300.00 to B8010.11 from A1410.11

$250.00 to B8020.11 from A 1410.11


RES TO AUTHORIZE ASSESSOR TO SIGN WALTHER SETTLEMENT AGREEMENT   On motion by Councilwoman Sieg and seconded by Councilman Argotsinger to authorize Kathy  all in favor.
