Body:

A regular meeting of the Mayfield Town Board met Wednesday, November 16, 2005 at the Village Hall 13 North School Street.

 

PRESENT

Kathy Sieg, Councilwoman

 

OTHERS PRESENT: Mike Stewart CEO, Kathi Hillock Assessor, Rick Argotsinger, Jack Putman, Betty Tabor Historian, James Cownie, Attorney Greco, Tom Ruliffson Highway Superintendent

 

The meeting was called to order at 6:30 PM by Supervisor Carol Hart and opened with the Pledge of Allegiance led by Supervisor Hart.

 

PUBLIC- James Cownie reported that four members of the Zoning Board of Appeals had recently attended the workshop at the Fulton Montgomery Community College on Land Use Regulations. Mike Stewart also attended the workshop.

 

DEPARTMENT REPORTS

 

HIGHWAY SUPERINTENDENT REPORT- the Highway Superintendent was not present at this time. Councilwoman Sieg reported that the new garbage truck should be arriving soon.

Councilwoman Sieg suggested that the town check with the State DOT regarding the Rte 30 Bridge to see if they have any plans to repair it.

Supervisor Hart reported that the School Street Bridge is in need of some repair to the fencing. A discussion followed.

 

ASSESSOR REPORT- Kathi Hillock, Assessor submitted her monthly report which included seven 2005 small claims assessment review cases.

 

DOG CONTROL OFFICER REPORT was submitted.

 

COMMITTEE REPORTS/ UPDATES

ADIRONDACK ASSOCIATION OF TOWNS & VILLAGES LETTER- A request to join in funding for a grant in regard to land usage in APA.

REVIEW PENDING PROJECTS- Supervisor Hart submitted a list of pending projects that either needs to be completed or passed on to the next board to be completed in the future.

1. Beach Safety Plan

2. Town Road Specs

3. School Street Bridge

4. Records Management Grant

5. Finish annual audit

 

Attorney Greco arrived at 7:00 PM

 

RES#160 CHANGE MEETING TIME FOR DECEMBER 7TH MEETING

On motion by Councilman Ryan and seconded by Councilman Hill the following resolution was ADOPTED 5 AYES (Hart, Montanye, Ryan, Hill, Sieg) 0 NAYS

 

RESOLVED that the Mayfield Town Board approves to change the time of the December 7, 2005 meeting to 5:30 PM.

 

The board continues with their review of pending projects

6. Removal of temporary gas tank at town highway department

7. Skating Rink

8. Inventory

9. Remodeling of court room

 

Tom Ruliffson, Highway Superintendent entered the meeting at 7:01 PM.

 

RES#161 OPEN PUBLIC HEARING ON 2006 PRELIMINARY BUDGET

On motion by Councilwoman Montanye and seconded by Councilman Ryan the following resolution was ADOPTED 5 AYES (Hart, Montanye, Ryan, Hill, Sieg) 0 NAYS

 

RESOLVED that the Mayfield Town Board approves to open public hearing on the 2006 Preliminary Budget at 7:03 PM.

Mike Stewart CEO read the public hearing notice.

There was no public comment. The public hearing was left open and the town continued with town business.

 

RES# 162 OPEN PUBLIC HEARING ON PROPOSED LOCAL LAW # 3 0F 2005 ZONING LAW.

On motion by Councilwoman Sieg and seconded by Councilman Hill the following resolution was ADOPTED 5 AYES (Hart, Montanye, Ryan, Hill, Sieg) 0 NAYS

 

RESOLVED that the Mayfield Town Board approves to open public hearing on proposed local law # 3of 2005 Zoning Law at 7:10 PM

Attorney Greco gave an update on the proposed local law.

Dorothy Hart, Town Clerk read the public hearing notice.

There was no public comment. The public hearing was left open and the town continued with town business.

 

RES# 163 MOVE INTO EXECUTIVE SESSION

On motion by Councilman Ryan and seconded by Councilman Hill the following resolution was ADOPTED 5 AYES (Hart, Montanye, Ryan, Hill, Sieg) 0 NAYS

 

RESOLVED that the Mayfield Town Board approves to move into executive session at 7:14 PM for the purpose of pending litigation.

 

RES# 164 MOVE INTO REGULAR SESSION

On motion by Councilwoman Montanye and seconded by Councilman Hill the following resolution was ADOPTED 5 AYES (Hart, Montanye, Ryan, Hill, Sieg) 0 NAYS.

 

RESOLVED that the Mayfield Town Board approves to move out of executive session and back into regular session at 7:30 PM.

 

Supervisor Hart requested any public comment on the Public Hearings for 2006 Budget .and Local Law. There was no public comment.

 

RES# 165 CLOSE PUBLIC HEARING ON 2006 PRELIMINARY BUDGET

On motion by Councilwoman Sieg and seconded by Councilman Hill the following resolution was ADOPTED 5 AYES (Hart, Montanye, Ryan, Hill, Sieg) 0 NAYS

 

RESOLVED that the Mayfield Town Board approves to close the public hearing on the 2006 preliminary budget at 7:30 PM.

 

RES# 166 CLOSE PUBLIC HEARING ON PROPOSED LOCAL LAW # 3 OF 2005 ZONING LAW

On motion by Councilman Hill and seconded by Councilwoman   Montaye the following resolution was ADOPTED 5 AYES (Hart, Montanye, Ryan, Hill, Sieg) 0 NAYS

 

RESOLVED that the Mayfield Town Board approves to close the public hearing on the proposed local law # 3 of 2005 at 7:31 PM.

 

RES# 167 ADOPTION OF 2006 PRELIMINARY BUDGET

On motion by Councilman Hill and seconded by Councilwoman Sieg the following resolution was ADOPTED 5 AYES (Hart, Montanye, Ryan, Hill, Sieg) 0 NAYS

 

RESOLVED that the Mayfield Town Board adopts the preliminary 2006 budget as the budget for 2006. The 2006 Town of Mayfield budget to follow at the end of the minutes of November 16, 2005.

 

RES# 168 ADOPTION OF LOCAL LAW # 3OF 2005

On motion by Councilwoman Sieg and seconded by Councilman Hill the following resolution was ADOPTED 5 AYES (Hart, Montanye, Ryan, Hill, Sieg) 0 NAYS

 

RESOLVED that the Mayfield Town Board approves Local law # 3 of 2005 titled A local law amending  Local Law No.2 of the year 2005 (Zoning Law) The purpose of this Local Law is to amend the Zoning Law of the Town of Mayfield by adding two new provisions thereto, without affecting the original substance or intent thereof.  

 

MUNICIPAL BUILDING- Supervisor Hart reported that Mike Stewart CEO had received quotes for the inside work at the fire district. A discussion was held on the quotes received. A discussion was also held on the RFP’s for driveway work at the Fire District for phase 2.

 

RES# 169 APPOINTMENT OF SCOTT BROOKS FOR CONTRACT WORK AT FIRE DISTRICT

On motion by Councilman Ryan and seconded by Councilman Hill the following resolution was ADOPTED 5 AYES (Hart, Montanye, Ryan, Hill, Sieg) 0 NAYS

 

RESOLVED that the Mayfield Town Board appoints Scott Brooks the awarded contract bid for inside work at the Fire District at $8,820.00 pending fire district approval.  

 

FINANCIAL

TOWN CLERKS REPORT- was submitted with fees collected in the following accounts A account $119.12 B account $1384.12 Decals $49.40

 

VOUCHERS- A discussion was held on the donation to the Broadalbin Ambulance.

 

RES# 170 APPROVAL OF PAYMENT OF VOUCHERS

On motion by Councilman Hill and seconded by Councilwoman Montanye the following resolution was ADOPTED 5 AYES (Hart, Montanye, Ryan, Hill, Sieg) 0 NAYS

 

RESOLVED that the Mayfield Town Board approves the payment of vouchers in the following accounts

PREPAID- vouchers 24-25    $1001.88

GENERAL TOWNWIDE –vouchers 314-351   $73,708.60

GENERAL OUTSIDE- vouchers 97-104      $4,207.85

HIGHWAY OUTSIDE- vouchers 189-204     $77,129.60

 

MUNICIPAL BUILDING- Supervisor Hart updated the board on signs for the inside and outside of the building.

Councilwoman Sieg questioned on the clerk of the works status. A small discussion followed between the board and Mike Stewart CEO.

Supervisor Hart thanked Mike Stewart for all his hard work.

Tom Ruliffson, Highway Superintendent questioned if the town would still be doing the plowing and sanding at the fire district. The Board noted that the Town was in contract with the Fire District for plowing and sanding of property.

 

A discussion was held on the School Street Bridge. Tom Ruliffson Highway Superintendent reported that he had three people look at the work that needed to be done.

 

A discussion was held on the road specs.

 

Councilwoman Montanye questioned if someone had been hired to fill the vacancy on the Sanitation truck. Tom Ruliffson reported that he had two employees rotating at the present time.

 

Tom Ruliffson Highway Superintendent reported that there were about twenty five gun shot holes in the door of the gate house at the town beach.

 

Councilman Ryan questioned if the town had heard anything on the post office moving to another location.

 

Councilman Hill suggested combining the assessing department with another municipality.

 

RES# 171 APPROVAL OF MINUTES

On motion by Councilwoman Sieg and seconded by Councilman Ryan the following resolution was ADOPTED 5 AYES (Hart, Montanye, Ryan, Hill, Sieg) 0 NAYS

 

RESOLVED that the Mayfield Town Board approve the minutes of October 12, 2005, October 19, 2005, October 26, 2005 & November 2, 2005 as submitted.

 

CORRESPONDENCE

A letter from   Mark Myers was received submitting his resignation from the Planning Board.

A letter was received from Time Warner Cable informing the town they were merging with Comcast.

A letter was received from the Walter Elwood Museum was received requesting a donation.

 

PUBLIC / OTHER

Holiday Gathering- December 28th at the Fire District building. The gathering will be from 4:30-6:30 with our year- end meeting at 6:30 PM. Supervisor Hart suggested inviting the fire department to this.

 

Councilwoman Montanye questioned the hours of the town clerk’s office when we move to the Fire District building.

 

RES# 172 ACCEPT MARK MYERS RESIGNATION FROM PLANNING BOARD

On motion by Councilman Ryan and seconded by Councilman Hill the following resolution was ADOPTED 5 AYES (Hart, Montanye, Ryan, Hill, Sieg) 0 NAYS

 

RESOLVED that the Mayfield Town Board approve the resignation of Mark Myers from the Planning Board effective November 16, 2005.

 

A discussion was held on having the holiday gathering catered this year since we will be having more people attend. Councilwoman Sieg will check into getting prices and report back.
