Body:

A regular meeting of the Mayfield Town Board was held on Wednesday, November 2, 2005 at the Mayfield Village Hall 13 North School Street.

OTHERS PRESENT: Mike Stewart CEO, Herb McLain, Rick Argotsinger, Jack Putman, James Cownie, Betty Tabor Historian, Tammy Miller, Aarron Miller, Tush Nikollaj

The meeting was called to order at 6:30 PM by Councilman Doug Hill and opened with the Pledge of Allegiance led by Mike Stewart CEO.

PUBLIC- Betty Tabor, Historian expressed her thanks to everyone who attended her exhibit at the Mayfield Library.

DEPARTMENT REPORTS

HIGHWAY DEPARTMENT- Councilwoman Sieg reported that the paving on Perigue Road and Sunrise Drive has been completed.

BUSHNELL ROAD BRIDGE- Councilwoman Sieg reported that money has been put in the 2006 budget and the board has decided to let the incoming board make the final decision on what to do.

Jack Putman entered the meeting at 6:35PM.

Herb McLain, Supervisor elect expressed his concern with the idea of closing the bridge. A discussion followed regarding whether to close the bridge or fix the bridge. Some board members feel it would cost the taxpayers a great deal of money to repair the bridge.

CODE ENFORCEMENT OFFICER REPORT- Mike Stewart CEO reported that 26 permits were issued for the month. A discussion was held on the beautifician grant.

MUNICIPAL BUILDING- The site plan review was discussed. Councilman Ryan commented on the drawing for the parking lot. A small discussion followed.

Tami and Aarron Miller arrived at 6:54 PM.

Supervisor Carol Hart entered the meeting at 7:00 PM

A discussion was held on the three quotes that were submitted for paving at the Fire District Building.

RES# 154 AWARD PAVING QUOTE

On motion by Councilman Ryan and seconded by Councilwoman Montanye the following resolution was ADOPTED 5 AYES (Hart, Montanye, Ryan, Hill, Sieg) 0 NAYS

RESOLVED that the Mayfield Town Board approves to award the paving contract to Delaney Construction for paving work at the Fire District building pending approval by the Fire Commissioners. This resolution is made pursuant to the authority granted by Section 103, Subdivision 4 of the General Municipal law permitting the awarding of a contract for public work without competitive bidding in the case of an emergency or other unforeseen circumstance affecting a public building or public property.

James Cownie entered the meeting at 7:05 PM.

RES# 155 OPEN PUBLIC HEARING ON FIRE CONTRACT

On motion by Councilman Hill and seconded by Councilwoman Sieg the following resolution was ADOPTED 5 AYES (Hart, Montanye, Ryan, Hill, Sieg) 0 NAYS

RESOLVED that the Mayfield Town Board approves to open public hearing on fire contract with Broadalbin Kennyetto Fire Department for fire protection in the Town of Mayfield at 7:00 PM

Mike Stewart CEO read the public hearing notice. There was no public comment.

The public hearing notice was left open and the town board continued with t own business.

RFPS for inside work at the municipal building was discussed. Mike Stewart CEO has been working on a revised RFP for work that must be done, work that should be done and work that could be done at a later date.

A possible moving date of the second week of December was discussed for moving to Fire District building.

CORRESPONDENCE

ENCON-Shaker Mountain Wild Forest Notice

NYSDOT- Speed Reduction on County Highway 154 to 45 mph.

NEXTEL- A tower application has been received by the planning board for a tower to be located in the town of Mayfield.

CRANBERRY CREEK A petition from residents on Gilbert Road was received in regard to Bushnell culvert.

APA MEETING- November 4, 2005

Tush Nikollaj arrived at 7:30 PM.

RES#156 CLOSE PUBLIC HEARING ON FIRE CONTRACT

On motion by Councilman Hill and seconded by Councilwoman Montanye the following resolution was ADOPTED 5 AYES (Hart, Montanye, Ryan, Hill, Sieg) 0 NAYS

RESOLVED that the Mayfield Town Board approves to close the public hearing on the fire contract at 7:30 PM

Supervisor Hart read the proposed local law 3 of the year 2005.

RES#157 SET PUBLIC HEARING ON PROPOSED LOCAL LAW # 3 0F THE YEAR 2005.

On motion by Councilman Hill and seconded by Councilwoman Sieg the following resolution was ADOPTED 5 AYES (Hart, Montanye, Ryan, Hill, Sieg) 0 NAYS

RESOLVED that Local Law No.3 of the year 2005 entitled A local law amending Local Law No. 2 of the year 2005 (Zoning Law) is hereby introduced for future adoption by the Mayfield Town Board, and it is further

RESOLVED that a public hearing regarding the adoption of said Local Law be held on Wednesday, November 16, 2005 commencing a 7:00 P.M. and that notice of such public hearing be duly published by the Town Clerk, in accordance with the law.

RES# 158 AUTHORIZE SUPERVISOR TO SIGN CONTRACT FOR FIRE PROTECTION

On motion by Councilman Ryan and seconded by Councilman Hill the following resolution was ADOPTED 5 AYES (Hart, Montanye, Ryan, Hill, Sieg) 0 NAYS

RESOLVED that the Mayfield Town Board authorize Supervisor Hart to sign contract with the Broadalbin Kennyetto Fire Department for fire protection services in the town of Mayfield for a sum of $35,725.09 for the period of January 1, 2006 to December 31, 2006.

Supervisor Hart presented a budget review and thanked the board for all their work on the budget to keep the tax rate at .36 per assessed thousand.

RES # 159 SET PUBLIC HEARING ON PRELIMINARY BUDGET

On motion by Councilman Ryan and seconded by Councilman Hill the following resolution was ADOPTED 5 AYES (Hart, Montanye, Ryan, Hill, Sieg) 0 NAYS

RESOLVED that the Mayfield Town Board schedule a public hearing on the preliminary budget for November 16, 2005 at 6:45 PM.

REMINDERS

Fulton County Planning training Session Nov. 9th 7-9PM at FMCC

PUBLIC-

Betty Tabor, Historian reported that a longtime resident of the Village of Mayfield, Dick Stewart had passed away. He would have been 100 years old in January.

Aarron & Tami Miller of 319 Vandenburgh Point Road questioned the board on a paper street across from them. They would like to access the lake by using Clemons Road which has some trees across it. The Millers asked permission to clear the trees from the road.

Supervisor Hart reported that she would need to check with the town Attorney on this.
